No peddler, solicitor or transient merchant may <br /> 4 enter in or upon any premises or attempt to enter in or upon any premises where such <br /> 5 placard or sign is placed. <br /> 6 <br /> 7 1130.10 Revocation. Any registration may be temporarily suspended by the City Manager or <br /> 8 revoked by the Council for a violation of any provision of this Section. Before any <br /> 9 temporary suspension or revocation occurs, the registrant will be notified of the <br /> 10 violation and will have the opportunity to respond to it. <br /> 11 <br /> 12 1130.11 Compliance with Zoning. Transient merchants must comply with all applicable <br /> 13 provisions of the City's Zoning Code. <br /> 14 <br /> 15 1130.12 Investigation and Issuance. <br /> 16 <br /> 17 (a) Upon receipt of each application, it shall be referred to the Chief of Police who <br /> 18 shall immediately institute such investigation of the applicant's business and moral <br /> 19 character, as he/she deems necessary including,but not limited to, a criminal history <br /> 20 and a wanted person's check with the Bureau of Criminal Apprehension for the <br /> 21 protection of the public good. Each applicant and agent of the applicant must sign <br /> 22 an"Informed Consent" acknowledging the reason for which the criminal <br /> 23 background is being completed. <br /> 24 <br /> 25 (b) If as.a result of such investigation, the applicant's business and moral character are <br /> 26 found to be unsatisfactory, the Chief of Police shall endorse on such application <br /> 27 his/her disapproval and his/her reasons for the same, and return the application to <br /> 28 the City Clerk who shall notify the applicant that his/her application is disapproved <br /> 29 and that no permit shall be issued. Any applicant's business and moral character <br /> 30 may be found to be unsatisfactory for reasons including,but not solely limited to: <br /> 31 <br /> 32 a. Fraud, misrepresentation, or incorrect statement contained in the <br /> 33 application for permit. <br /> 34 b. Past fraud, misrepresentation, or incorrect statement made in the course of <br /> 35 carrying on business as a solicitor, canvasser,peddler, transient merchant, <br /> 36 itinerant merchant or itinerant vendor. <br /> 37 C. Past conviction of any crime or misdemeanor involving fraud, theft, or <br /> 38 moral turpitude. <br /> 39 d. Conducting the business of a peddler, solicitor, transient merchant, <br /> 40 itinerant merchant or itinerant vendor, as the case may have been, in an <br /> 41 unlawful manner or in such a manner as to constitute a breach of peach or <br /> 42 to constitute a menace to health, safety, or general welfare of the public. <br /> 43 <br /> 44 (c) If as a result of such in investigation, the business and moral character of the <br /> 45 applicant are found to be satisfactory,the Chief of Police shall endorse on the <br /> 46 application his/her approval and return the application to the City Clerk, who <br /> 47 shall deliver the permit to the applicant.
