DAILEY <br /> October 27 , 1988 <br /> TO: THE -PLANNING COMMISSION OF THE CITY COUNCIL OF THE <br /> CITY OF ST. ANTHONY <br /> I hereby request a variance from the existing ordinance of the <br /> City of St. Anthony which requires a building to be set back 30 <br /> feet from the road right-of-way. I request the variance from <br /> this ordinance in order to relieve an undue hardship and to <br /> correct extraordinary circumstances applicable to my lot located • <br /> at 2813 Silver Lane N.E. This request is made for the following <br /> reasons: <br /> 1. While the City Ordinance would have only required a rear <br /> lot setback of 25% of the total lot length, i.e. , <br /> approximately 37 feet, the Rice Creek Watershed District <br /> insisted upon a 57 foot setback . See Exhibit "A" . As <br /> a result, it was impossible to construct the proposed <br /> home without a variance from the street setback require- <br /> ment. While there is some question about the authority <br /> of the Rice Creek Watershed District to limit the set- <br /> back to 57 feet, it is reasonable in this case since the <br /> adjoining properties are set back approximately that far <br /> from the lake, and construction of this home closer to <br /> the lake may constrict the neighbors ' views of the lake. <br /> 2. The existing garage which was demolished on -approxima- <br /> tely October 21 , 1988 , was set back approximately 12 <br /> feet from the right-of-way. The site of the proposed <br /> garage is 13 feet from the right-of-way at its east <br /> corner and 17 feet from the right-of-way at its west <br /> -corner. <br /> 3. Both of the adjoining neighbors have indicated that they <br /> have no objection to the proposed residence. See • <br /> Exhibits "B" and "C" attached. <br />
