DRAFT NO. 2 <br /> CITY OF ST.ANTHONY,MINNESOTA <br /> Proposed Secondhand Dealers Ordinance <br /> Section 565—Secondhand Dealers <br /> Section 565 of the St.Anthony City Code is repealed and shall be replaced by a new Section 565 <br /> as follows: <br /> 565.01. Findings and Purpose Statement. <br /> The City Council finds (i)that secondhand dealers may knowingly or unknowingly be a <br /> conduit for the sale or purchase of stolen property; (ii) secondhand dealers should be regulated <br /> by requiring a license issued by the City; and(iii) licenses for should be denied, suspended, or <br /> revoked when the conduct of such business presents a threat to the peace, health, or safety of the <br /> people of the City. The purpose of this Section is to provide for the peace, health, and safety of <br /> citizens of the City by regulating secondhand dealers. <br /> 565.02. Definitions. <br /> The following words and terms when used in this Section shall have the following <br /> meanings unless the context clearly indicates otherwise: <br /> AUCTION HOUSE: Auction house dealer shall mean any secondhand dealer where <br /> some, or all, of the secondhand merchandise is offered for sale for <br /> the highest bid or offer tendered. If the sale is conducted by means <br /> of an auction, the auctioneer must be properly licensed and bonded <br /> in accordance with applicable laws. <br /> BILLABLE Every reportable transaction conducted by a secondhand <br /> TRANSACTION: dealer, regardless of the number of items received in that <br /> transaction. <br /> BUSINESS MANAGER: Business manager shall mean a person(s) designated by the <br /> licensee to operate a business in the licensee's absence. A licensee <br /> must designate a manager to operate the licensed business if the <br /> licensee does not personally provide on-site supervisory services at <br /> the business at least sixty-four(64)hours per month. <br /> CITY: The City of St. Anthony, Minnesota. <br /> CONSIGNMENT: A written agreement between a licensee and a seller that enables <br /> the licensee to take temporary possession of secondhand property, <br />
