MEMORANDUM
DATE : April 16 , 1982
TO: Planning Commission Members
FROM: Ron Berg, Administrative Assistant
SUBJECT: ---Craig-Morris - .Letter of Credit/Landscaping Conformance
-----------------------------------------
The Letter of Credit for $3 ,200 , issued to the City to assure
landscaping conformance , will expire May 1st.
There are two principal components in the landscaping plan. The one
is shrubbery. He did place some shrubbery around the area last
fall . They are small now and don ' t appear very healthy . He was also
to place shrubs along his northern lot line, but as a practical
matter, it was agreed last fall that nothing could be done there
• until the townhouse construction is completed.
The other component is the proposed fencing. The original plan was
for redwood fencing. However, last fall (.see attached minutes) the
agreement was for chain link fencing. On inspection of the site , I
note some partial wood construction, which apparently is supposed
to turn out to be fencing. This is not the agreement.
The option is simple. Cash in the Letter of Credit or give another
extension. He certainly has had his opportunity to comply with his
proposal and it will be up to him to make any case he has now.
For the sake of argument, I will note that the weather has not been
condusive to any fence building; Mr. Lee 's house construction
(on the adjoining lot-Penrod) has been going on and not completed;
if we cash in , we will have to put in the fence.
ROB/cjk
