r- <br /> 1 PUBLIC HEARINGS <br /> 102 The public hearing on the property tax assessment against 3316 Skycroft <br /> 3 Circle was opened at 8: 35 P.M. by Mayor Pro Tem Ranallo. The notice of <br /> 4 hearing had been published in the Bulletin on July 26 and August 2, 1989 <br /> 5 and was delivered by certified mail to the property owner, Frances Cheng <br /> 6 at her California address. <br /> 7 Mr. Wallace Anderson, 3321 Skycroft Circle, which is directly across <br /> 8 from the Cheng property, was present to comment on the increasingly poor <br /> 9 appearance of the property. <br /> 10 The owner's son, Dr. John Cheng, had contacted Acting City Manager <br /> it VanderHeyden prior to the hearing and indicated he had been unaware of <br /> 12 the large amount of overdue bills but would like to attempt to pay the <br /> 13 bills before they are certified to the County. Ms. VanderHeyden <br /> 14 suggested that, because the son was very cooperative and the City has <br /> 15 until October to certify, she would recommend the Council approve <br /> 16 Resolution - 89-020 and the resolution would not be certified to the <br /> 17 County for one month, allowing the Cheng's to yet resolve the issue. <br /> 18 The City Attorney confirmed the legality of this procedure and indicated <br /> 19 that the City could indeed certify the assessment if all costs are not <br /> 20 paid. <br /> 21 The public hearing was closed at 8:45 P.M. <br /> 2 Before the motion to approve Resolution 89-020 was made, the <br /> 3 Councilmembers directed that the legal fees incurred since the <br /> 24 Resolution .was developed should also be paid by the property owners in <br /> 25 a separate motion. <br /> 26 Motion by Marks, seconded by Enrooth to approve the resolution <br /> 27 certifying water bill, maintenance, and legal costs, to include an 8% <br /> 28 rate _ of interest per annum on those costs; said interest to begin in <br /> 29 one month (September 8, 1989) , to the County Auditor regarding property <br /> 30 at 3316 Skycroft Circle. <br /> 31 RESOLUTION 89-020 <br /> 32 A RESOLUTION CERTIFYING CHARGES TO THE COUNTY <br /> 33 AUDITOR TO BE LEVIED- AGAINST CERTAIN PROPERTIES <br /> 34 FOR COLLECTION WITH THE TAXES PAYABLE IN 1990 <br /> 35 Motion carried unanimously. <br /> 36 Motion by Marks, seconded by Makowske to add onto the above costs as <br /> 37 listed in Resolution 89-020 any and all legal fees incurred by the City <br /> 38 must also be paid by the property owner of 3316 Skycroft Circle. <br /> 39 Motion carried unanimously. <br /> • <br /> 5 <br />
