• 410 . 06 Right to Discontinue Service . No water service will be <br /> shut off for nonpayment until the customer has been afforded an <br /> opportunity for an impartial hearing pursuant to Section <br /> 410 . 05, Subd 2 . If no hearing is requested within the required <br /> time, service will be shut off . If a hearing is requested, <br /> service will be shut off unless a valid reason for nonpayment <br /> is demonstrated at the hearing . If a hearing is so requested, <br /> it will be held by the Director of Public Works within six <br /> working days of such request . If , as a result of the hearing, <br /> the Director of Public Works finds that the amount claimed to <br /> be owing is actually due and unpaid and that there is no legal <br /> reason why the water service may not be discontinued, then the <br /> City may discontinue water service . <br /> 410 . 07 Taking Water Without Authority. It is unlawful for any <br /> person to use City water service without proper authority. <br /> 410 . 08 Water Restrictions . To promote and protect the public <br /> health, safety and welfare of the City and its residents, it <br /> may be necessary during periods of draught or unusual water use <br /> for the Council to declare the existence of an emergency with <br /> respect to the use of City water and to provide for restricted <br /> use . The Council will sit as an Emergency Water Supply Board, <br /> which may declare the existence of such emergencies as , and <br /> when, it may be necessary to impose and enforce water use <br /> restrictions . <br /> • 410 . 09 Sprinkling Regulations . No person may draw or use the <br /> City water system for the purpose of watering lawns or gardens <br /> during any period of emergency as declared under Section 410 . 08 <br /> except during the days and hours permitted . Notice of the <br /> emergency and any permitted watering will be given by <br /> publication and posting . At no time may a hose larger than <br /> one-inch in diameter be used from any service pipe without <br /> special permission of the Council , and upon payment of a fee <br /> set forth in Chapter 6 for the water to be used from such <br /> special connection. <br /> 410 . 10 Penalty for Violation. If a person violates the water <br /> emergency provisions , the Council may cause the person ' s water <br /> service to be shut off . Service will not be restored until <br /> payment of the fee set forth in Chapter 6 . <br /> 410 . 11 Responsibility for Repairs and Maintenance . <br /> Subd . 1 . R-1 and R-2 Property Owners . Each owner of <br /> single-family residential (R-1) or two-family residential <br /> (R-2) property having a building connected to the public <br /> water system is responsible for all repairs and maintenance <br /> of that portion of the system which runs from the building <br /> to the curb stop, including any connection at the curb stop . <br /> • 4-6 <br />
