. Section 535 - REVOCATION OR SUSPENSION <br /> 535 . 01 Right to Revoke. Every license issued under this <br /> Chapter -is subject to the right, which is hereby expressly <br /> reserved, to suspend or revoke the same should the licensee or <br /> the licensee ' s agents , employees , representatives or lessees <br /> directly or indirectly operate or maintain a licensed premises <br /> or otherwise conduct activities contrary to the provisions of <br /> state or federal law, this Code, or any permit issued by the <br /> City. <br /> 535 . 02 written Notice . A license may be suspended or revoked <br /> by the Council after written notice to the licensee specifying <br /> the violations . The notice will also specify the date for a <br /> hearing before the Council, which will not be less than 10 days <br /> after the date of notice. <br /> 535 . 03 Hearing . At the hearing, the licensee may present any <br /> evidence relevant to the violations specified in the notice. <br /> 535 . 04 After a Hearing . After a hearing, the Council may <br /> suspend or revoke the license if deemed necessary to protect <br /> the public health, safety or welfare . <br /> Section 540 - SUMMARY ACTION <br /> 540 . 01 Action by City Manager . When the conduct of a licensee <br /> or the licensee ' s agent, representative, employee or lessee, or <br /> the condition of the licensed premises , constitutes a nuisance, <br /> fire or health hazard, unsafe or dangerous condition, or other <br /> emergency, the City Manager may summarily close off the <br /> premises or a portion of it . <br /> 540 . 02 Appeal to Council . Any person aggrieved by a decision <br /> of the City Manager is entitled to appeal to the Council , <br /> immediately, by filing a notice of appeal with the Manager . <br /> The Manager will schedule a date for hearing before the Council <br /> and notify the aggrieved person of the date . <br /> 540 . 03 Hearing. The hearing will be conducted in the same <br /> manner as if the aggrieved person had not received summary <br /> action . <br /> 540 . 04 City Manager ' s Decision . The decision of the City <br /> Manager is not voided by the filing of such appeal . Only after <br /> the Council has held its hearing and made its decision, will <br /> the decision of the City Manager be affected . <br /> 5-5 <br />
