Accessory Structure Setback Permit <br /> 4 <br /> 5 The public hearing was opened at 7:06 P.M.. <br /> 6 <br /> 7 Management Assistant Urbia provided a staff report. The proposed ordinance <br /> 8 language was provided by the City Attorney, which was previously used in the City <br /> 9 of Deephaven. The proposed language will assist residents in building double <br /> 10 garages, and allows the Planning Commission and City Council to grant the building <br /> 11 of these garages without violating a State law regarding granting variances only if <br /> 12 hardship is met. <br /> 13 <br /> 14 Commissioner Madden requested staff research the issue of storage sheds and draft <br /> 15 some language that could be included in an ordinance (but not the current proposal). <br /> 16 <br /> 17 Chair Faust opened the public hearing to discussion. Mr. Pete Loomis, 2933 <br /> 18 Crestview, questioned the difference between a permit and an ordinance. Chair <br /> 19 Faust explained how the permit would allow flexibility without having to prove <br /> 20 hardship to grant a variance. • <br /> 21 <br /> '22 The public hearing was closed at 7:18 P.M.. <br /> 23 <br /> 24 Commissioner Gondorchin questioned the use of 528 square feet and 24 feet width. <br /> 25 Chair Faust and Commissioner Franzese stated that these numbers meet today's <br /> 26 standards, and may have to be changed in the future. Commissioner Gondorchin felt <br /> 27 the State Building Code should be referenced to see what a standard double garage <br /> 28 is. <br /> 29 <br /> 30 Motion by Franzese, second by Madden to recommend approval to the City Council <br /> 31 of the proposed Accessory Structure Setback Permit ordinance. <br /> 32 <br /> 33 Commissioner Madden questioned if any reasons would need to be stated in the <br /> 34 motion. The Commission felt that would not be necessary. <br /> 35 <br /> 36 Commissioner Franzese raised the concern regarding visibility and sightline issues. <br /> 37 She wanted to be sure that a permit would not be granted if it harmed a neighbors <br /> 38 visibility/sightlines. <br /> 39 <br /> 40 Motion approved unanimously <br /> 41 <br /> 42 • <br />
