Commissioner Bergstrom added that the Planning <br /> 3 Commissioners were sympathetic to the Johnson and tried to figure out <br /> 4 a way to recommend granting their request within the rules. <br /> 5 <br /> 6 Mayor Ranallo was of the opinion that the best way to do that would be <br /> 7 to change the side yard to the front yard. He stated this could be easily <br /> 8 done for this request, but there will probably be more requests like this <br /> 9 forthcoming. For example, the Mercil's house on Silver Lake <br /> 10 Road/Townview. <br /> 11 <br /> 12 Mr. Johnson stated he has approval of the neighbors who were <br /> 13 considering the safety factor. City Attorney Soth said this appears to be <br /> 14 a good reason to designate Coolidge Street the front yard. Mayor <br /> 15 Ranallo perceived a variance cannot be granted because there is really no <br /> 16 hardship. Councilmember Enrooth said the City needed some criteria to <br /> 17 make this decision. Soth stated the alignment of the property makes this <br /> 18 a very unique situation. Mayor Ranallo indicated the Planning <br /> Commission should work with Mr. Hamer to set up some very definite <br /> q00 criteria. Enrooth asked Bergstrom if he sees any problem in this case, <br /> 21 especially in setting up precedence. Bergstrom responded that he felt <br /> 22 that during the Planning Commission discussions there weren't any <br /> 23 concrete conditions or rules that would allow us to distinguish situation <br /> 24 where this would or would not be appropriate. <br /> 25 <br /> 26 Motion by Fleming, second by Ranallo to approve the designation of the <br /> 27 backyard to the side yard at 2800 - 36th Avenue N.E. due to the <br /> 28 orientation of the adjoining property to the east back yard, and therefore <br /> 29 negating the need for a variance for a 6 foot high fence. <br /> 30 <br /> 31 Motion carried unanimously. <br /> 32 <br /> 33 Ranallo issued a directive to the Interim City Manager to work with the <br /> 34 Planning Commission in setting up criteria for odd shaped corner lots <br /> 35 regarding fences and with a goal toward minimum fencing. <br /> 36 <br /> 37 2. MAKO. Inc., concept review for three parcels on Old Highway 8 and <br /> 38 Rankin Road. MAKO, Inc. is the owner and developer. Chet <br /> 39 Makowske was present representing MAKO. The properties were sold <br /> in 1981 on a Contract for Deed which defaulted and the properties <br /> 1 reverted to the MAKO group in 1993. The owners are looking for <br />
