City Council Regular Meeting Minutes <br /> April 25, 1995 <br /> Page 6 <br /> 1 In response to Marks, Mr. Beach indicated it is normal for a house to conforni to the <br /> 2 shape of the lot but there is the privacy issue and also the square footage issue with this <br /> 3 lot. <br /> 4 Marks questioned if it would be more appropriate to wait until there is a buyer, as they <br /> 5 may want to lay the house out differently on the property. He indicated he felt Mr. Beach <br /> 6 had been very responsive to the neighbor's concerns but he was concerned for the person <br /> 7 who would actually be living in the proposed home. <br /> 8 Mrs. Moncada stated she was not satisfied with the proposal. She indicated the house did <br /> 9 not conform to the lot as it was required to face Townview and the lot was shaped for the <br /> 10 house to face Silver Lake Road. <br /> -11 Mayor Ranallo showed Mrs. Moncada the plat and explained the different options to her <br /> 12 in detail. <br /> 13 Enrooth stated the City had caused the problem by requiring that ingress and egress <br /> 14 points be off Townview. <br /> 4V6 Marks indicated a precedent had been set when granting the variances for 3112 Silver <br /> Lake Road. <br /> 17 Motion by Marks, second by Wagner to approve the front yard variance of fifteen feet; <br /> 18 the ordinance requires 30 feet, backyard variance of twelve feet; the ordinance requires 25 <br /> 19 feet, and the lot area variance of 440 square feet; the ordinance requires 11,000 square <br /> 20 feet, for 3111 Silver Lake Road, on the basis the diagram and footprint presented by Mr. <br /> 21 Beach be followed as he presented it here, as there is an undue hardship due to the. <br /> 22 physical surrounding shape, topography, and conditions of the parcel, the proposed <br /> 23 variance is based not exclusively on the desire to increase the value or the income of the <br /> 24 potential parcel but would correct extraordinary circumstances that apply to other <br /> 25 properties in the vicinity or zoning district,the difficulty in this hardship is due to City <br /> 26 Ordinance, in regards to public safety this would represent the best use of the property <br /> 27 placement of the house versus placing it on Silver Lake road, verification of the survey of <br /> 28 the parcel, drainage issue of property addressed by the City Engineer, and the property <br /> 29 cleared of any remaining non-conforming structures. <br /> 30 Motion carried unanimously. <br /> 31 <br /> 32 Chairman Bergstrom reported he had been a member of the Planning Commission for <br /> 33 two years and had recently been appointed as Chairman. He indicated he felt the <br /> Planning Commission should be more involved with planning issues regarding the City <br /> N of St. Anthony. He reported he was trying to instigate a process within the Planning <br /> 36 Commission to (#1)Think about being more into the planning end of things, (#2) <br />
