City Council Regular Meeting Minutes <br /> April 25, 1995 <br /> • Page 3 <br /> 1 Ranallo noted he had checked with City Manager and City Engineer and no variances are <br /> 2 required on these lots. <br /> 3 Marks and Enrooth both expressed concern that due to the irregular shapes of the lots, <br /> 4 there would be variances requested. <br /> 5 Wagner noted in the letter from Kemper& Associates, Inc. of April 18, 1995, the permit <br /> 6 for access to Lot 5 from Highway 88 was pending. <br /> 7 In response to Marks, Mornson reported City Attorney Soth had indicated that everything <br /> 8 on the preliminary plat does comply with City Code and that all lots are buildable with a <br /> 9 typical house size without a variance. <br /> 10 Motion by Marks, second by Wagner to approve the request for property subdivision of <br /> 11 3220 - 29th Avenue N.E. into five lots and the attached preliminary plat, on the basis that <br /> 12 all zoning ordinances are met, the title search and City expense issues are brought to <br /> 13 completion as outlined in the letter from William Soth of April 18, 1995, all lots are <br /> 14 platted and buildable according to City Code, and that access is provided for Lot 5. <br /> 0 6 Motion carried unanimously. <br /> 17 2. John Bulicz. Autotraac. 3009 - 37th Avenue N.E. - Sign Variance Request. <br /> 18 Chair Bergstrom reported the owner, John Bulicz, has submitted a petition for a sign <br /> 19 variance requesting that he be allowed to have a second identification sign on a <br /> 20 commercial building having only one right-of-way frontage. He is requesting an <br /> 21 additional sign because his current sign is not readily noticeable to anyone looking for his <br /> 22 business. The linear footage allowed for signage by the sign ordinance has the current <br /> 23 Autotraac sign facing south and is clearly visible to the residential area directly across the <br /> 24 street. Bergstrom reported Mr. Bulicz is unable to install a ground sign on the site <br /> 25 because Ramsey County widened the width of the road. He indicated Mr. Bulicz is <br /> 26 asking to be allowed to paint an identifying wall sign on the west side of the building. <br /> 27 The proposed sign,which would be 13 feet by 5 feet or 65 square feet, is within the <br /> 28 specifications of the sign ordinance regulating the size of wall signs. The proposed wall <br /> 29 sign is 8% of the wall surface and the sign ordinance limits a wall sign to not more than <br /> 30 15% of the wall surface. This proposed identifying signage would be visible from the <br /> 31 westbound and northbound roadways, 37th and Silver Lake Road. Bergstrom reported <br /> 32 Judy Fruth spoke at the meeting representing Autotraac and there was no other public <br /> 33 testimony at the Planning Commission meeting. Bergstrom indicated the Planning <br /> 34 Commission recommended approval of the sign variance for a second identifying sign for <br /> 35 Autotraac, 3009 - 37th Avenue N.E., on the basis that it is within the sign surface <br /> regulation, the strict enforcement of the ordinance would cause a hardship as the plight <br /> was not created by the land owner, these are unique circumstances to the individual, and <br /> 38 that it would not alter the essential character of the locality.
