City Council Regular Meeting Minutes <br /> April 25, 1.995 <br /> • Page 4 <br /> 1 square footage of the existing sign and the proposed second sign are still below the total <br /> 2 square footage of signage allowable by City Code. <br /> 3 Councilmember Fleming arrived at 7:15 P.M. <br /> 4 Marks confirmed that Berger Transfer had indeed expanded outward toward the street <br /> 5 after Autotraac was in business. He indicated he was having difficulty finding the <br /> 6 hardship for this variance. <br /> 7 Mr. John Bulicz, Owner of Autotraac, reported he has talked to numerous customers who <br /> 8 have driven past Autotraac for'ten years and never knew the business existed. He stated <br /> 9 he was trying to expand the business, to prosper and grow in this community. <br /> 10 Motion by Enrooth, second by Fleming to approve a sign variance that would allow a <br /> 11 second identifying commercial sign for Autotraac, 3009 - 37th Avenue N.E., on the basis <br /> 12 that it is within the sign surface regulation, the strict enforcement of the ordinance would <br /> 13 cause hardship as the plight was not created by the land owner, these are unique <br /> 14 circumstances to the individual, and it would not alter the essential character of the <br /> 15 locality. <br /> 406 Vote: Councilmembers Enrooth, Ranallo, Fleming, and Wagner voted yes. <br /> 17 Councilmember Marks voted nay. <br /> 18 Motion carried. <br /> 19 3. Larry Beach 3111 Silver Lake Road. Front and Back Yard Setback Variance and <br /> 20 Lot Area Variance. <br /> 21 . Chair Bergstrom reported the petition was requesting variances for property at 3111 <br /> 22 Silver Lake Road. He stated this property was acquired as part of the St. Anthony HRA <br /> 23 program for scattered-site redevelopment. The same process was initiated for 3112 Silver <br /> 24 Lake Road in 1993. These two lots are the same size and Larry Beach is proposing to <br /> 25 redevelop the 3111 Silver Lake Road property. In order to build an updated, modern <br /> 26 home, Mr. Beach has petitioned for the following variances which will be required for the <br /> 27 redevelopment of 3111 Silver Lake Road. They are the same variances that were <br /> 28 approved for 3112 Silver Lake Road. A front yard variance of fifteen feet; the ordinance <br /> 29 requires 30 feet in the front yard setback. Back yard variance of twelve feet; the <br /> 30 ordinance requires 25 feet in the back yard setback. Lot area variance of 440 square feet <br /> 31 because it is a corner lot; the ordinance requires that corner lots have a square footage of <br /> 32 11,000 feet. This lot has 10,560 square feet. Bergstrom reported that currently, the <br /> 33 property at 3111 Silver Lake Road has a front yard setback of approximately 15 feet and <br /> Q4 in addition, there is a six foot right-of-way that the City owns. The proposed structure <br /> 5 will sit 21 feet from Townview Avenue and it's west side yard will be 31 feet from Silver <br /> 36 Lake Road. The back of the structure will be 13 feet from the property line and abuts the <br />
