City Council Regular Meeting Minutes <br /> February 25, 1997 <br /> • Page 5 <br /> 1 City Attorney asked if a development agreement had been drafted for the proposal which <br /> 2 would include-improvements and a landscape plan. <br /> 3 Mornson stated the City does not typically prepare development agreements for projects when <br /> 4 the City is not involved in the financing. <br /> 5 Mr. Beach stated the proposal will include landscaping and sod. Utilities will be obtained <br /> 6 from a trunk to the sewer in Highway 88. <br /> 7 City Attorney indicated a development agreement may not be necessary if there are no new <br /> 8 public improvements and the City Ordinances address the landscaping and other requirements. <br /> 9 Motion by Marks, second by Faust to approve the 1st reading of the rezoning request for Lots <br /> .10 2, 3, 4, and 5 of Block 1, Verkins Addition from R-1 Single Family designation to an R-3 <br /> 11 Townhouse designation. <br /> 12 Motion carried unanimously. <br /> 13 Motion by Marks, second by Enrooth to approve the preliminary plat for lots 2, 3, 4, and 5 of <br /> 14 Verkins Addition subject to the vacation of all easements as per City Attorney advisement. <br /> Motion carried unanimously. <br /> 16 <br /> 17 Marks noted a hardship would need to be demonstrated to allow for granting of the 12 foot <br /> 18 backyard setback variance. He indicated the hardship was the unusual shape of the lot. <br /> 19 Motion by Marks, second by Enrooth to grant a 12 foot backyard setback variance for Lot 5 <br /> 20 of the Verkins Addition due to the hardship created by the unusual shape of the lot. <br /> 21. Motion carried unanimously. <br /> 22 <br /> 23 Mornson advised Mr. Beach to apply for the easement vacations this week. The second <br /> 24 reading of the rezoning will be held on March 11 and the third reading of the rezoning and <br /> 25 the easement vacation will be considered on March 25, 1997. He also noted Mr. Beach will <br /> 26 still need to prepare a final plat for consideration at the March 25, 1997 meeting. <br /> 27 Ms. Makowske cautioned that there may also be snow fence easements on the property on <br /> 28 Highway 88. <br /> 29 Commissioner Delmonico reported the Planning Commission is still working on the Ordinance <br /> 30 Amendment in regard to ground signs. <br /> • <br />
