City Council Regular Meeting Minutes <br /> June 24, 1997 <br /> Page 6 • <br /> 1 Mr. Rosar stated his building will be 49 feet from the street. Most cities only require a 50 <br /> 2 foot setback. He stated he will gladly take one foot off his proposal. <br /> 3 Enrooth stated the City had never made any promises in regard to CUB or Knox. They had <br /> 4 only discussed what may take place. <br /> 5 Mr. Rosar stated the developer, C.G. Rein, had made the promises. <br /> 6 Faust noted a condition of the current conditional use permit is that no more than two vehicles <br /> 7 can be stored on the site for a period of no more than 72 hours. He stated he has driven by <br /> 8 the site many times and seen more than two vehicles. He noted that this past Sunday there <br /> 9 was even a boat for sale on the site. <br /> 10 Mr. Rosar stated he has also driven by on Sundays and there have been boats and cars for <br /> 11 sale on the site. The boats and cars do not belong to him or his employees but belong to <br /> 12 residents in the area. The only solution would be to chain the parking lot. He acknowledged <br /> 13 that there are some items on the site which he has requested be removed. <br /> 14 Wagner noted the original use of the site was for brake and exhaust repair. He asked if the <br /> 15 brake repair was being discontinued due to the addition of the oil change and the car wash. <br /> 16 Mr. Rosar explained that when he originally purchased the property he owned Fast Glass, • <br /> 17 Glass Company and the business was to be a combination glass and muffler shop. He has <br /> 18 since sold the glass business due to a change in the industry and therefore looked for another <br /> 19 compatible business as it is too costly to run only the exhaust shop. He noted the business <br /> 20 has always included brake repair. He has been made aware of a customer complaint in regard <br /> 21 to the brake service and is trying to locate the complaint. He has never told a customer that <br /> 22 the business does not perform brake service and neither has any of his current employees. <br /> 23 Exhaust Pros is a franchise which currently is in turmoil due to a physical injury of the <br /> 24 owner. <br /> 25 Mr. Rosar noted the proposed improvements will cost $400,000 and will include a new hip <br /> 26 roof around the entire building with panels. <br /> 27 Faust asked if the Planning Commission had seen a site plan or elevation of the proposal. <br /> 28 Commissioner Gondorchin indicated this was presented at the concept review and a sketch <br /> 29 was included in the Commissioner's packet. <br /> 30 Mr. Edward Mattson, 3933 Silver Lake Road, indicated_he lives in the townhomes across the <br /> 31 street from Exhaust Pros. He stated that all the residents in the townhomes object to the noise <br /> 32 emanating from the shop and feel it is more than was expected. The anticipated noise <br /> 33 associated with the addition will make the business even more objectional to the residents <br /> 34 across the street. <br />
