City Council Regular Meeting Minutes <br /> June 24, 1997 <br /> • Page 7 <br /> 1 Ms. Eileen Spano, 4009 Silver Lake Road, asked if the improvements could be made without <br /> 2 the car wash. She. felt the car wash would cause a traffic problem. With CUB located at <br /> 3 Apache, the traffic has increased, making it difficult for the townhome.owners to cross over <br /> 4 Silver Lake Road or to make a left hand turn. She reported people are using their private <br /> 5 roadway to turn around and questioned how much more the residents were to be <br /> 6 inconvenienced. She asked how late the car wash would be open. <br /> 7 Commissioner Gondorchin stated the car wash will be open 24 hours per day as it will be <br /> 8 robotically operated. <br /> 9 Mr. Rosar stated he would like the business portion of the site to be open for operation on <br /> 10 Sunday from 10:00 A.M. to 4:00 P.M. <br /> 11 Ms. Spano asked if the car wash would be supervised. <br /> 12 Mr. Rosar indicated the car wash will not be supervised and will be similar to the car wash at <br /> 13 the Amoco. The concept is that the husband and wife will come to Apache and the wife will <br /> 14 shop while the husband washes the car. He noted there are many car washes located in this <br /> 15 confined area and he did not feel this proposal would generate a significant amount of traffic. <br /> Marks asked what could be included in the conditional use permit to ensure the landscaping <br /> 47 would be done. <br /> 18 City Attorney Soth stated that the requirements should be expressly stated, in detail, as <br /> 19 conditions of the conditional use permit. If the conditions are not met, there would not be a <br /> 20 conditional use permit and the business could be closed down. <br /> 21 Wagner noted the conditions were included in the previous conditional use permit and they <br /> 22 were not met. <br /> 23 Soth stated the Council needed to be-careful how the conditions were numerated and worded <br /> 24 to obtain the desired results. <br /> 25 Morrison confirmed that if the conditions were not met, the business owner would have to be <br /> 26 cited and taken to court before the business could be shut down. <br /> 27 Soth confirmed this was correct. <br /> 28 Morrison noted Staff has addressed the non-compliance of the original conditional use permit <br /> 29 administratively via letters and visits to the site. <br /> Enrooth noted Mr. Rosar had stated at the Planning Commission meeting that there are people <br /> interested in purchasing the site. <br />
