Mornson, City Manager <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: Tobacco Ordinance <br /> Attached is a draft of the proposed tobacco ordinance that the City is required to adopt. State <br /> regulations suggest that if a unit of local government is unable to adopt such an ordinance, then <br /> the County with jurisdiction will implement and enforce the tobacco regulations as established <br /> by the State of Minnesota. <br /> The attached draft ordinance is taken from the League of Minnesota Cities model ordinance. <br /> The City Attorney has reviewed it and made revisions; the Chief of Police and the Liquor <br /> Operations Manager have both reviewed the propose ordinance. There was a question about <br /> developing and enforcing additional administrative penalties, but in speaking with both Mr. <br /> • Soth and the Police Chief, they agreed that the current prosecutorial system is adequate to <br /> enforce the tobacco ordinance once it is adopted by the City Council. <br />
