Re: Salvation Army Property - Moratorium <br /> Dear Mayor Cavanaugh and Members of the Council: <br /> You have requested advice regarding the possible extension of the existing moratorium on the <br /> Salvation Army Camp property. As we discussed earlier,under state law if the City is conducting <br /> studies or has authorized a study to be conducted, to consider adoption or amendment of its <br /> comprehensive plan or zoning ordinances,the City may adopt a moratorium ordinance to restrict or <br /> prohibit use, development or subdivision of property for a period not to exceed one year. As you <br /> know, this was done. Under the state statute, the moratorium can then be extended for such additional <br /> periods as may be deemed to be appropriate, not to exceed a total additional period of 18 months. <br /> You have asked me to discuss the several alternatives available to the City with respect to the <br /> moratorium. If you take no action, the moratorium will expire by its own terms on May 11, 2000. If <br /> this occurs, the existing zoning will remain in effect and it will be possible for parties to seek building <br /> permits and rezoning or other land use approvals with respect to the property. Obviously, you would <br /> not be required to approve any rezoning, especially if it is not consistent with your comprehensive plan, <br /> but you would be required to issue a building permit if the building to be constructed was a permitted <br /> use in the Recreational/Open Space District and otherwise complied with all of the City's ordinances <br /> pertaining to this property. <br />
