29 <br /> Subd. 3. Assessments. In the event the City incurs charges relating to the enforcement of <br /> this Section, including without limitation expenses relating to third-party consultants and <br /> removal of abandoned Towers and WTFs,the City reserves the right to assess the property <br /> owner for such charges in the same manner in which the City assesses and collects real property <br /> taxes. <br /> Section 1680.08. Nonconforming Uses. <br /> Subd. 1. Collocation of Additional Antennas. Antennas that are collocated, in <br /> accordance with the provisions of this Section, shall not be deemed to constitute the expansion of <br /> a nonconforming use or structure. <br /> Subd. 2. Preexisting Towers. Preexisting Towers shall be allowed to continue their <br /> usage as they presently exist. Routine maintenance shall be permitted on such preexisting <br /> Towers. New construction other than routine maintenance on a preexisting Tower shall comply <br /> with the requirements of this Section. <br /> Subd. 3. Rebuilding damaged or destroyed nonconforming Towers or Antennas. A <br /> nonconforming Tower, Antenna or WTF that is damaged or destroyed by wind, storm, fire or <br /> similar acts of God may be rebuilt without having to first obtain administrative approval or a <br /> conditional use permit. The type, height, and location of the Tower or WTF shall be of the same <br /> type and intensity as the original facility approval. Building permits to rebuild the facility shall <br /> comply with the then applicable building codes and shall be obtained within 180 days frdm the <br /> date the facility is damaged or destroyed. If no permit is obtained or if said permit expires, the <br /> Tower or Antenna shall be deemed abandoned as specified in Section 1680.09. <br /> Subd. 4. Nonconforming Use/Abandonment. A nonconforming Tower or WTF that <br /> becomes nonfunctional for thirty(30) consecutive days shall be deemed abandoned. <br /> Section 1680.09. Removal of Abandoned Towers and WTFs. Any Tower or WTF that is not <br /> operated for a continuous period of twelve (12) months shall be considered abandoned, and the <br /> owner of such Tower or WTF shall remove the same within ninety(90) days of receipt of notice <br /> from the City of such abandonment. Failure to remove an abandoned Tower or WTF within <br /> such 90-day period shall be grounds for the City to remove the Tower or WTF at the property <br /> owner's expense. If there are two or more users of a single Tower,then this provision shall not <br /> P g P <br /> become effective until all users cease using the Tower for a continuous period of twelve (12) <br /> months. <br /> Section 1680.10. Regulation of Dish Antennas. <br /> Subd. 1. Permits. No Dish Antenna may be erected, constructed or placed, or re-erected, <br /> re-constructed or replaced, anywhere'within the City without first making an application for and <br /> obtaining a permit from the City, except for the following: <br /> 12 <br />
