46 <br /> authorization executed by the owner of the premises, for the applicant's use of the <br /> premises for the sale, display, distribution, and storage of Consumer Fireworks; <br /> I. Any affidavits of the applicant as required by the Clerk, on forms provided by <br /> the Clerk, in support of the application; <br /> J. The applicant's written authorization to release information obtained in <br /> connection with the application; <br /> K. A statement signed by the applicant and, where the applicant is not the owner <br /> of the premises for which the license is sought, from the property owner stating that he or <br /> she has reviewed and understands the pertinent provisions of this Section and State law; <br /> and <br /> L. Any additional information deemed necessary by the Clerk to undertake <br /> consideration of the application. <br /> 580.05. License Application Verification and Consideration.- <br /> The provisions of Section 500 of this Code apply any and all licenses granted <br /> under this Section and to the holders of such licenses, provided that all licenses shall be <br /> granted or denied by the City Council if required by State law. The Clerk is authorized to <br /> conduct any and all investigations necessary to verify the information supplied on an <br /> application, including ordering a computerized criminal history inquire and/or driver's <br /> license history inquiry on the applicant. After verifying application information, the <br /> Clerk shall route the application to the City's fire department which shall review the site <br /> plan and determine if the manner of sale, display, distribution, and storage constitutes a <br /> fire or safety hazard. In assessing the potential hazards, reference shall be made to all <br /> applicable state and federal laws, rules, and regulations as well as to the administrative <br /> standards of the sale, display, distribution, and storage of Consumer Fireworks <br /> established by the Minnesota Department of Public Safety, State Fire Marshal Division. <br /> If no fire or safety hazards are identified, the license shall be granted in accordance with <br /> this Section. If the application is denied, the Clerk shall notify the applicant of such <br /> denial in writing. The notice shall be mailed by regular and certified mail to the applicant <br /> at the address provided in the application and it shall inform the applicant of the <br /> applicant's right, within twenty (20) days from the date of the notice, to submit a written <br /> request to the Clerk for an appeal of the denial to the City Council. Appeals that are <br /> timely-received shall take place before the City Council within reasonable period. <br /> 580.06. License Fee. <br /> The annual license application fee shall be the amounts set forth in Section <br /> 615.06 of this Code. The amount of the license fee will depend upon whether the <br /> Fireworks Dealer is engaged in the business of selling only Consumer Fireworks. The <br /> license fee shall cover the administrative and enforcement costs, including the costs <br /> associated with conducting unannounced compliance checks, inspections by the fire <br /> department, inspections by the police department, as well as sampling and testing of the <br /> merchandise to ascertain chemical content. Full payment of the required license fee shall <br /> accompany the application. A separate fee and license shall be required for each <br /> 7 <br />
