48 <br /> amount or validity of taxes, the City Council may on application waive strict compliance <br /> with this provision; no waiver may be granted, however, for taxes or any portion thereof <br /> which remain unpaid for a period exceeding one (1) year after becoming due. <br /> B. Improper Zoning. No license shall be granted if the property is not properly <br /> zoned for the activity being licensed under Chapter 16 of this Code, unless the business is <br /> a legal, nonconforming use. <br /> C. Non-Permanent Place of Business. No license shall be granted for the sale of <br /> Consumer Fireworks at a Non-Permanent Place of Business. <br /> 580.10. License Restrictions. <br /> A. License Display. A license issued under this Section must be posted in a <br /> conspicuous place in the premises for which it is used. The license issued is only <br /> effective for the compact and contiguous space specified in the approved license <br /> application. <br /> B. Licensed Premises. A separate license is required for each place of <br /> business. <br /> C. Change in Ownership. Any change, directly or beneficially, in the <br /> ownership of the licensed business shall require the application for a new license and the <br /> new owner must satisfy all current eligibility requirements. <br /> D. Non-transferable. Each license under this Section shall be issued to the <br /> applicant only and shall not be transferable to any other person. No licensee shall loan, <br /> sell, give or assign a license to another person. <br /> E. Location restrictions. A license under this Section authorizes the licensee to <br /> carry on its business only at the permanent place of business designated on the license. <br /> However, upon written request, the City may approve an off-site locked and secured <br /> storage facility. Such a site must meet all City zoning requirements and must have the <br /> written approval of the City's fire department. The licensee shall permit inspection of the <br /> facility in accordance with this Section. Property shall be stored in compliance with all <br /> provisions of the City Code and in compliance with the standards established by the <br /> City's fire department. The licensee must either own the building in which the business <br /> is conducted, and any approved off-site storage facility, or have a lease on the business <br /> premises which extends for more than six (6) months. No retail business transactions <br /> shall be conducted at this off-site storage site. <br /> 580.11. Operation Restrictions. <br /> A. Customer Safety Information Provided. At the point of sale, each <br /> purchaser of Consumer Fireworks shall be provided with safety information complied by <br /> the Minnesota Department of Public Safety, State Fire Marshal Division or other such <br /> safety information as directed by the Clerk or City Council. <br /> 9 <br />
