02 <br /> City Council Regular Meeting Minutes <br /> July 22, 2003 <br /> Page 2 <br /> 1 Chris Schober, 2902 Crestview Drive, came forward to address Council as a representative of the <br /> 2 St. Anthony Huskies Dugout Club. Ms. Schober provided handouts to Council detailing the <br /> 3 discussions regarding the design and placement of two dugouts and a concession stand and stated <br /> 4 she had come before the Council to indicate a community need for action regarding this issue. <br /> 5 She discussed the activities of the coach, Park Commission, School Board and URS as they <br /> 6 related to the project. She noted there had been no mention that a different process should be <br /> 7 followed; therefore, a permit had been requested. Ms. Schober stated she felt the internal <br /> 8 struggle taking place among the park, City and School Board erupted when the permit was <br /> 9 requested. She noted the reason given for stopping the project was warranty issues; however, <br /> 10 warranty problems had not been previously mentioned. Ms. Schober said funds had been <br /> 11 donated for a worthwhile project and she wanted help to reach a resolution. She indicated a <br /> 12 letter from School District 282 approving the concession stand and the dugout design with some <br /> 13 noted changes. She also referred to the Dugout Club's rebuttal letter responding to the URS <br /> 14 memo regarding proposed press box and dugouts. Ms. Schober added the dugouts were to <br /> 15 protect the players, and the Dugout Club wanted the dugouts and concession stand completed as <br /> 16 soon as possible. She noted this project was volunteer based and supported by the community. <br /> 17 <br /> 18 Mayor Hodson noted this had been a topic of discussion the last eight to nine months. He asked <br /> 19 Mr. Morrison if there was a way this could be handled efficiently. Mr. Morrison suggested the <br /> 20 issue be deferred until the following Tuesday, after it had been discussed with the School Board. <br /> 21 He added a decision should be made after that meeting. Mr. Mornson noted the superintendent <br /> 22 and school-board chair had indicated they did approve the dugouts; however, URS and the Park <br /> 23 Commission had some concerns. He added the Park Commission did not seem to be in total <br /> 24 agreement. <br /> 25 <br /> 26 Mayor Hodson responded there probably never would be total agreement and he wanted to <br /> 27 indicate action would be taken. Mr. Morrison suggested staff be given direction after Tuesday's <br /> 28 meeting. Mayor Hodson stated he would follow up with Ms. Schober the following Wednesday <br /> 29 or Thursday. <br /> 30 <br /> 31 Rod Bloom, 3506 Skycroft Drive, stated the warranty issue, as it related to the park grass, was <br /> 32 humorous because of the current condition of the grass. Mr. Mornson responded the warranty <br /> 33 was a one-year warranty that was required on projects, and the warranty had not started. He <br /> 34 noted the project would be closed, there would be a one-year wait, a punch list would be <br /> 35 completed and, in the meantime, a bond would be held against the company. <br /> 36 <br /> 37 Mayor Hodson noted it was a topic the Council needed to address. He added the City needed to <br /> 38 have each"i" dotted and"t"crossed on the punch list. He stated the City needed to confirm the <br /> 39 area was adequately seeded and weeds were controlled. Mr. Morrison responded that mowing, <br /> 40 seeding, fertilizing, etc., was part of the contract and, as soon as the City took over those tasks, <br /> 41 the argument could be made it was the City's project and the warranty was ended. <br /> 42 <br /> 43 Ms. Schober stated she had talked with Jay Hartman regarding an exception to the warranty so <br /> 44 the projects could be completed by the next baseball season. <br /> 45 <br /> 46 Councilmember Faust stated all parties were trying to do what was right for the entire <br /> 47 community. He asked Mr. Mornson if he had the time needed to sort through the issue by next <br />
