Housing and Redevelopment Authority Meeting Minutes 02 <br /> March 9, 2004 <br /> Page 2 <br /> 1 letter had been received earlier in the day asking the HRA to commence with the action; <br /> 2 therefore, a change needed to be made to the resolution to clarify that direction had been <br /> 3 received. <br /> 4 <br /> 5 Mr. Gilligan indicated this action would hopefully only be a housekeeping matter, as he expected <br /> 6 the HRA would not have to proceed to acquire the property by eminent domain. He stated the <br /> 7 Purchase Agreement was entered into under threat of condemnation and it was requested the <br /> 8 HRA show evidence of that. <br /> 9 <br /> 10 Chair Hodson invited residents to come forward regarding this issue. No one came forward to <br /> 11 address the HRA. <br /> 12 <br /> 13 Chair Hodson closed the public hearing at 8:10 p.m. <br /> 14 <br /> 15 Motion by Commissioner Stille, seconded by Commissioner Faust, to adopt Resolution HRA 04- <br /> 16 005, relating to acquisition of property by exercise of power of eminent domain and Resolution <br /> 17 HRA 04-006 authorizing condemnation of CUB parcel. <br /> 18 <br /> 19 Discussion: <br /> 20 <br /> 21 Mr. Gilligan noted the following change needed to be made to Resolution HRA 04-005: <br /> 22 Beginning at line 6 of the last paragraph of the first page of the resolution, it should read". . <br /> 23 under its power of eminent domain; and that the attorneys for the HRA are instructed and <br /> 24 directed to file the necessary petition therefor and to prosecute such action to a successful <br /> 25 conclusion, . . ." He further explained the words "if subsequently requested by St. Anthony <br /> 26 Retail' should be eliminated from the resolution. <br /> 27 <br /> 28 Friendly amendment by Commissioner Faust to accept the changes to Resolution HRA 04-005 <br /> 29 requested by City Attorney Gilligan. <br /> 30 <br /> 31 Motion carried unanimously. <br /> 32 <br /> 33 IV.
