I REGULAR COUNCIL MEETING <br /> 2 JULY 9, 1991 • <br /> 3 PAGE 4 <br /> 4 <br /> 5 <br /> 6 A canopy over the southeast entance to Walker on Kenzie is <br /> 7 being proposed in order to prevent ice and &now buildup <br /> 8 which presents a safety problem. The proposed canopy will be <br /> 9 nine feet from the property line and will require a sixteen <br /> 10 foot variance from the twenty-five feet required by the <br /> 11 P.U. D. .The sixteen foot variance is being requested from the <br /> 12 P.U.D. requirement of twenty-five feet, but the actual <br /> 13 variance will only be nine feet from the present seventeen <br /> 14 foot setback. It was stated that a hardship exists because <br /> 15 of the safety concerns. <br /> 16 <br /> 17 The Planning Commission is recommending the City Council <br /> 18 approve the sixteen foot variance on the southeast side of <br /> 19 Walker on Kenzie., 2626 Kenzie Terrace, for the purpose of <br /> 20 allowing Phoenix Construction N.W. , Inc. to construct a <br /> 21 canopy of eight feet in 'length nine feet from the property <br /> 22 line, in order to remedy ice buildup at the southeast <br /> 23 entrance; noting that the three statutory requirements for a <br /> 24 variance were met; and noting that no one appeared in <br /> 25 opposition to the request. <br /> 26 <br /> 27 Motion by Marks, second by Fleming to approve the . variance <br /> 28 request for Walker on Kenzie using the same findings as the <br /> 29 Planning Commission . <br /> 30 <br /> 31 Motion carried unaninouslY <br /> 32 <br /> 33 <br /> 34 <br /> 35 2. Rezoning of Certain Non-Conforming Properties <br /> 36 <br /> 37 The properties which were being recommended for rezoning <br /> 38 that were considered by the Planning Commission consist of <br /> 39 each and every townhouse and condominium within the Mirror <br /> 40 Lake development, all with Foss Road addresses, as well as <br /> 41 the property located at 2900 St. Anthony Boulevard. <br /> 42 <br /> 43 The Foss Road properties are currently zoned L-1, which is <br /> 44 to be changed to R-4, and that the 2900 St. Anthony <br /> 45 Boulevard property is currently zoned C, which ' in to be <br /> 46 changed to R-1 . <br /> 47 <br /> 48 Commissioner Franzese advised all of these recommended <br /> 49 changes comply with the existing uses and the changes would <br /> 50 not impact on property taxes. <br /> 51 <br /> 52 <br /> 53 • <br /> 54 <br />
