Burt, City Manager <br /> FROM: David Mark Urbia, Management Assistant <br /> ITEM: HOSPICE IN A RESIDENTIAL ZONE <br /> I called the LMC Research Division to inquire if hospices are treated as group homes by <br /> State Statute. According to LMC, after. referring to statutes 245A.02 and 462.351, there <br /> appears to be no statutes that treat hospices similar to group homes. The significance of this <br /> is City zoning ordinances are over-ridden by State statutes for placement of group homes. <br /> Since it appears this is not the case for hospices, the City has zoning authority over the <br /> placement of a hospice in a residentially zoned district. It might be wise to double check <br /> with the City Attorney on this matter. <br /> Under current zoning, it appears this use is allowed in R-3 and R-4 zones under the <br /> permitted conditional use of nursing care homes (Section 6, Subd. 3,2). <br /> I contacted the inquiring company, and the currently have a hospice in a R-2 (duplex) zone <br /> in South Minneapolis with six beds. State law allows for up to eight beds. There is a need <br /> for overnight parking. The company is considering St. Anthony, as it is a low-crime, nice <br /> residential community. They would be looking for a location zoned R-2, R-3, or R-4. <br />
