STAFF REPORT DATE: November 18, 1997 TO: Planning Commission Members FROM: Kim Moore-Sykes, Management Assistant ITEM: 97-09 St. Charles Borromeo Catholic Church -- Conditional Use Permit Request BACKGROUND. In August, Gerald De Zelar, architect from Gerald De Zelar & Associates, contacted the City informing Staff that St. Charles Borromeo Catholic Church was planning to construct a fellowship hall addition to the church. This proposed construction constitutes a change to the structure and as a result of this proposed change, the church is required to obtain a conditional use permit for the property. St. Charles Borromeo Catholic Church was constructed in 1958, before the City's zoning districts and ordinances were codified. As such, the church has existed in this residential area without the required conditional use permit because it is a grandfathered use. In considering the request for the conditional use permit, it must be determined that: a. The use is one of the conditional uses specifically listed for the district in which the property is located; b. That specific conditions that are deemed necessary to make the use compatible with other uses in the area are determined and communicated to the applicant; C. The use will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity or to the values of property in the vicinity; and d. The use will provide a service or a facility which is in the interest of.public convenience and will contribute to the general welfare. St. Charles Borromeo Catholic Church is a conditional use that is specifically list in Section 1615.03 Permitted Conditional Uses, (a) of the City Code. St. Charles also concurs with the requirement that the use will not be detrimental to the health or general welfare of persons residing or working in the vicinity and does provide a service that is in the interest of the public and contributes to the Community's general welfare. 9
