MEMORANDUM <br /> DATE: 03/11/02 MEETING DATE: 03/19/02 <br /> TO: Planning Commission Members <br /> FROM: Susan Henry, Assistant City Manager X 4 <br /> SUBJECT: Village North, LLP, 2801 37th Avenue Northeast, Amend the <br /> Conditional Use Permit for Essenco, a candle manufacturer. <br /> Requested Action: <br /> The applicant, Ken Solie of Village North, LLP, property owner of the light industrial <br /> building at 2801 37th Avenue Northeast, is requesting an amendment to their current <br /> .Conditional Use Permit (CUP). The applicant is asking for the City to remove the <br /> September 1, 2002, expiration date, and in its place, place no expiration date. <br /> Background: <br /> On January 8, 2002, the City Council approved a conditional use permit submitted by <br /> Village Properties, for the packaging of wax and other components into candles. A <br /> company called Essenco now occupies the building at 2801 37th Avenue Northeast. <br /> Essenco manufactures candles. Their conditional use permit expires September 1, 2002 <br /> (see attached permit with conditions). <br /> Over the past several months, neighboring residents have been calling city offices <br /> complaining of the nuisance of strong candle-related smells (see attached city complaint <br /> log). <br /> The petitioner and its tenant, Essenco, are aware of the complaints. They are willing to <br /> install a new ventilating system, which should reduce the smells to the neighborhood, <br /> according to their proposal. Steve Levitis of Essenco has stated the proposed exhaust <br /> system is designed to reduce the odors 75 to 100 percent from what neighbors have <br /> been experiencing currently, depending on their distance from the discharge point and <br /> the weather and the wind conditions at the time. <br /> The cost for the new system is estimated up to $80,000 (see attached Essenco packet). <br /> Village Properties and Essenco is requesting permanent removal of an expiration date <br /> on their CUP in exchange for their investment in the expensive ventilating equipment. <br /> Essenco has stated it is important for them to know how they stand now, rather than <br /> later, as their busy season is nearby when the CUP expires on September 1, 2002. <br /> Attachments: <br /> • Application for Amendment to CUP (Ken Solie's e-mail) <br /> • Essenco Fragrance Mitigation Packet <br /> • 1/8/02 City Council Minutes <br /> • 12/18/01 Planning Commission Minutes <br /> • Current Conditional Use Permit <br /> • City Candle Complaint Log <br />
