City Council Regular Meeting Minutes <br /> January 8, 2002 <br /> Page 7 <br /> 1 suggested that they be able to operate with a conditional use permit, and fix <br /> 2 problems as they arise. <br /> 3 <br /> 4 Councilmember Thuesen asked for Gilligan's opinion on the subject. Gilligan <br /> 5 stated that he thought it would be very difficult to determine satisfactory progress <br /> t�'ess P <br /> 6 without a timeline. Gilligan continued that they could establish some objective <br /> 7 standards, such as the specific equipment that would be installed, by which to <br /> 8 measure progress. <br /> 9 <br /> 10 Tanner stated that he did not feel that the words"good faith"were appropriate <br /> 11 where Essenco was concerned, highlighting the fact that they were up and running <br /> 12 before they had a permit at all. <br /> 13 <br /> 14 Steve Levitus, owner of Essenco, came forward and stated that the early start-up <br /> 15 was a genuine misunderstanding on their behalf. He added that they have not <br /> 16 been operating for several weeks, and stated that he was completely committed to <br /> 17 working with the community. <br /> 18 <br /> 19 Mayor Hodson asked City staff if there was enough information for them to draft <br /> 20 an ordinance at this time,in order to give Essenco the ability to begin operations <br /> 21 again. <br /> 22 <br /> 23 Gilligan stated that it was difficult to do. He suggested that they set a time limit, <br /> 24 after which they could pull the conditional use if requirements of the permit were <br /> 25 not met. <br /> 26 <br /> 27 After much discussion,the Council decided to draft a revised version of the <br /> 28 conditional use permit that the Planning Commission recommended. They <br /> 29 decided that they would grant the permit based on a trial period that expires on <br /> 30 September 1, 2002. <br /> 31 <br /> 32 Councilmember Sparks was in disagreement with the length of time, feeling that it <br /> 33 was far too long. <br /> 34 <br /> 35 Solie stated that they could not appropriately respond to the requirements of a <br /> 36 conditional use permit based on a 6-month trial period. He added that, if that <br /> 37 were the case, they would simply revoke their request tonight. <br /> 38 <br /> 39 Resident Jennifer Tanner stated that her greatest concern was over what was being <br /> 40 done in"good faith"at this time to remedy the identified odor problem. <br /> 41 <br /> 42 Mayor Hodson clarified that the Council would only grant the permit through <br /> 43 September 1, 2002. <br /> 44 <br />
