Gilligan suggested that the Council went forth with a <br /> 3 . motion, and that Essenco determine what they will do once the motion has been <br /> 4 made. <br /> 5 <br /> 6 Motion by Councilmember Faust to grant the conditional use permit for Village <br /> 7 North, LLP, 2801 37th Avenue Northeast with the following conditions: <br /> 8 • Candle manufacturing can only occur between the hours of 6:00 a.m. <br /> 9 through 4:00 p.m., Monday through Saturday. <br /> 10 • The operation can operate until September 1, 2002 after which the <br /> 11 Planning Commission would hold a public hearing to determine whether, <br /> 12 or not, there exist problems associated with the smell. <br /> 13 • Conditional use permit may be revoked if findings on September 1, 2002 <br /> 14 indicated that the odor is injurious to the public health, and welfare, <br /> 15 including property values of the surrounding neighbors. <br /> 16 • After September 1, 2002,the City reserved the right to place any <br /> 17 additional, reasonable conditions on the use. <br /> 18 <br /> 19 Motion carried 4-1, Councilmember Sparks opposed. <br /> 20. <br /> 21 Levitus confirmed that the decision tonight meant that they were able to begin <br /> 22 operations again. Mayor Hodson stated that was true. <br /> 23 <br /> 24 It was determined that residents would call the Assistant City Manager Susan <br /> 25 Henry at(612) 706-1324 to formally register complaints. <br /> 26 <br /> 27 B. Ordinance 2002-001, re: Requires business licenses for massage therapy business <br /> 28 (first reading). <br /> 29 <br /> 30 Commissioner Steeves reviewed the findings of the Planning Commission. He <br /> 31 stated that they recommended it for approval as is. <br /> 32 <br /> 33 Councilmember Horst asked about the associated fees. <br /> 34 <br /> 35 Resident Mary Luger-Sarter reviewed the costs-associated with starting out in the <br /> 36 business of massage therapy, which were far less than the $5,000 of capital <br /> 37 investment noted in the ordinance. <br /> 38 <br /> 39 Councilmember Sparks stated that she felt they could drop the $5,000 fee <br /> 40 altogether. The Council agreed. <br /> 41 <br /> 42 Luger-Sarter commented on the $500 investigating fee. Gilligan stated that it was <br /> 43 a one-time fee, but the $250 licensing fee was annual. <br /> 44 <br />
