Planning Commission Meeting Minutes <br /> September 16, 2003 <br /> Page 13 <br /> 1 Commissioner Hanson asked if they could include a statement that guns could not be sold at this <br /> 2 location. Assistant City Attorney Chris Smith clarified that federal rules and regulations are <br /> 3 available that discuss firearms noting that it would be somewhat limited. Commissioner Hanson <br /> 4 asked if firearms could be sold if they do not make it part of the conditions. He referenced <br /> 5 Walmart noting that they are the number one gun seller in the country and that it should be <br /> 6 clarified that they are being asked not to sell guns per City requirements. Assistant City <br /> 7 Attorney Smith stated that he would review the regulations and update the Commission. <br /> 8 <br /> 9 Mr. Shardlow stated that he would also review regulations regarding the sale of firearms for City <br /> 10 Council. He stated that they are recommending that the Planning Commission recommend for <br /> 11 approval subject to several conditions that would also include all exhibits, the site plan, and all <br /> 12 documents that were included with the packet, the PUD concept plan, the design plan, the final <br /> 13 . plan for water and sewer, the finished grading plan and the final landscape and plat plan, subject <br /> 14 to approval by the City Engineer. He stated that the Developer would be responsible for <br /> 15 securing the Watershed prior to final approval. <br /> 16 <br /> 17 Chair Melsha referenced the traffic flow on the site and asked what has been discussed regarding <br /> 18 the impact along the Stinson and 37`h. Mr. Shardlow referenced the Environmental Assessment <br /> 19 Study and level of service noting that the level of service takes impact into account. He <br /> 20 explained that typically, in a redevelopment project, this has already been analyzed noting that <br /> 21 Todd Hubmer of WSB & Associates, did the EAW. <br /> 22 <br /> 23 Todd Hubmer stated that the completed traffic analysis shows that with a site like this the traffic <br /> 24 patters dissipate as it moves further away from the center and that they have found this to be true <br /> 25 and that it is consistent with this project. <br /> 26 <br /> 27 Chair Melsha asked for a description of the financial difficulties with this project with respect to <br /> 28 uses and referenced the big box retail component. Mr. Shardlow stated that it has not been easy <br /> 29 nor has it lacked effort. He reviewed with the Commission stating that it should begin with the <br /> 30 re-grade, fill the site, and improve the water flow. He explained that the developer has been <br /> 31 asked to purchase the properties and assured the Commission that the individual owners would <br /> 32 be treated fairly. He noted that additional costs to the development included the purchase of <br /> 33 private properties noting that the Cub Foods Store also had some extensive rights to cross <br /> 34 easements, which had to be purchased. He stated that this has been a very expensive and <br /> 35 difficult project. <br /> 36 <br /> 37 Chair Melsha stated that when this process began an analysis was done that showed that a lot of <br /> 38 retail in this area would not work and asked why the development team believes that this plan <br /> 39 would work for this location. Mr. Lindberg referenced the traffic study and the desire for a <br /> 40 traffic level A or B stating that they would prefer to see traffic at level D and reviewed with the <br /> 41 Commission. He explained that the fundamental reasons to make the main street successful is to <br /> 42 enhance what is going on around the Cub Foods Store. He stated that the area along the south <br /> 43 side is needed in order to drive the retail industry. He explained that the average shopping trip <br /> 44 has gone down from 58 minutes to 34 minutes and reviewed the study with the Commission. He <br /> 45 noted that the target market for most retailers are women between the ages of 24 to 45 and that <br /> 46 they should create an opportunity for the shopper to get in and out in 34 minutes.
