The Inspector <br /> 3 measured and gave verbal approval to pour the footings on February 23, <br /> 4 1990. <br /> 5 <br /> 6 The City Attorney observed that the date on Exhibit C was incorrect and <br /> 7 that it should be corrected to March 27, 1990. <br /> 8 <br /> 9 The stop work order was issued by the Public Works Director on either March <br /> 10 22, 1990 or March 23, 1990. Pirino advised that his family has been living <br /> 11 in an apartment and hoped to be in their home by May 1st. <br /> 12 <br /> 13 Councilmember.Marks reviewed the definition of "hardship" in the legal <br /> 14 context of land use. He noted that it can mean a lot with a strange shape <br /> 15 or the topographical conditions of the parcel . He referred to the size <br /> 16 of the Pirino lot, noting that it was not substandard in size such as <br /> 17 being too narrow or limited in square footage. Councilmember Marks recalled <br /> 18 that the Legislature defined "hardship" because of the manner in which the <br /> 19 land is subdivided it is necessary. He felt that rarely should there be a <br /> 20 need for a variance. He inquired if there is another location on the pro- <br /> 21 perty for the garage and felt that the length of the driveway was an hard- <br /> 22 ship of another kind. <br /> 23 <br /> 24 Councilmember Makowske felt the integrity of the neighborhood would still be <br /> • 25 maintained if the garage were placed on the front of the lot but- the neigh- <br /> 26 borhood would be more damaged if it were placed on the back of the lot. <br /> 27 <br /> 28 Motion by Makowske, second by Ranallo to deny the variance because the three <br /> �9 questions in the Petition for Variance cannot be answered in the affirmative, <br /> 30 the comments and observations of Councilmember Marks regarding hardships and <br /> 31 the conditions for granting variances, and the negative recommendation of <br /> 32 the Planning Commission. <br /> 33- <br /> 34 Motion carried unanimously. • <br /> 35 <br /> 36 B. Council Reports <br /> 37 <br /> 38 Councilmember Makowske will attend the Arbor Day Event. The Village Gardeners <br /> 39 will plant a tree in Trillium Park in memory of Vivian Wagner. She requested <br /> 40 staff to have a copy of the Arbor Day Proclamation prepared so she can take <br /> 41 it with her to the Event. <br /> 42 <br /> 43 Councilmember Makowske stated her intent to move forward in her seeking election <br /> 44 to the Hennepin County Board of Commissioners. She felt the outcomeof the <br /> 45 Endorsing Convention went well for her. <br /> 46_ <br /> 47 Councilmember Makowske stated that the Hennepin County Board is rethinking <br /> 48 its policy regarding reimbursements to the City for grass clippings and <br /> 49 leaves. VanderHeyden stated that the City will not receive any funding as <br /> 50 it does not have a transfer site. <br />
