Planning Commission <br /> 9 Commissioner Ted Brownell was in attendance representing the Planning <br /> 10 Commission. <br /> 11 <br /> 12 1 . Setback Variance Request - B. Zielinska , 2608/2610 37th Avenue <br /> 13 Ms. Zielinska is requesting a variance to the front yard setback require- <br /> 14 ment of the City ordinance to be allowed to build two double garages at <br /> 15 the front of the double bungalow. <br /> 16 <br /> 17 The request was originally presented to the Planning Commission on April <br /> 18 10th. At that time the Planning Commission recommended denial . The City <br /> 19 Council reviewed the request at its April 17th meeting and it was noted <br /> 20 that the plan had been amended. The Council referred the amended plan back <br /> 21 to the Planning Commission . <br /> 22 <br /> 23 At its May 15th meeting, the Planning Commission reviewed the amended <br /> W4 plan. Commissioner Brownell noted that this amended plan only decreased <br /> 25 the variance by three feet . He also noted that the minutes of the Plan- <br /> 26 ning Commission ' s meeting of May 15th accurately reflected the concerns <br /> 27 of the Commission members and of the staff. <br /> 28 <br /> 29 The City Manager referred to the required setback, that being thirty feet <br /> 30 or the same as the adjacent houses . <br /> 31 <br /> 32 Motion by Marks, second by Makowske to deny the request for the same reasons <br /> 33 given by the Planning Commission, those being ; <br /> 34 <br /> 35 1 . The three questions required to be answered in the affirmative in <br /> 36 the Petition for Variance had not been done so with the new pro- <br /> 37 posal . <br /> 38 <br /> 39 2. The safety factors and potential problems with the sewer line with <br /> 40 the proposed construction justified denial . <br /> 41 <br /> 42 3. Precedents for granting similar requests have not been established . <br /> 43 <br /> 44 4. The depth of the City' s right-of-way in front of this property made <br /> 45 the proposal even less acceptable. <br /> 46 <br /> 47 Motion carried unanimously <br /> 48 <br /> 049 2.
