Subd. 4 . Severe Infractions: In the case of a severe <br /> infraction, at the supervisor's discretion, Steps 1 and 2 <br /> (oral and written warning) may be omitted and the supervisor <br /> may implement Step 3 (suspension) immediately. Examples of <br /> severe infractions would include, but would not be limited to, <br /> the following: <br /> (a) Missing an entire day of work without notifying <br /> supervisor. <br /> (b) Walking off the job without reason and/or <br /> permission. <br /> (c) Insubordination. <br /> (d) Reporting to work under the influence of illegal <br /> drugs or alcohol. <br /> (e) Theft or deliberate misuse of City property. <br /> (f) Purposeful destruction of City property, . <br /> (g) Possession or sale of illegal or controlled <br /> substances. <br /> (h) Violation of applicable law in any respect. <br /> (i) Physical harassment or assault of a fellow <br /> employee, supervisor or private citizen. <br /> Subd. 5. Hearing: In any case of suspension, dismissal or <br /> demotion, a permanent employee shall be granted a hearing <br /> before the City Manager if the employee submits a written <br /> request for such a hearing to the City Manager within five <br /> working days of notification of the action taken. The hearing <br /> shall be held within ten working days from the date the <br /> request ,is filed unless the City and the employee agree on an <br /> earlier or later date. If the disciplinary action involves <br /> the removal of a veteran, the hearing shall be held in <br /> accordance with Minnesota Statutes. <br /> 300. 21 Unlawful Acts. <br /> Subd. 1. Falsification of Records.. No person will <br /> knowingly make any f Alse statement, certif icate, marks, rating <br /> or report in regard to any test, certificate or appointment <br /> held or made under the City personnel system, or in any manner <br /> commit or attempt any fraud preventing the impartial execution <br /> of the provisions of this Section. <br /> 3-12 <br />
