REGULAR COUNCIL MEETING <br /> JUNE 8 , 1993 <br /> 3 PAGE 7 <br /> 4 <br /> 5 <br /> 6 Councilmember Marks inquired on what hardship was the Planning <br /> 7 Commission ' s recommendation for approval based. <br /> 8 <br /> 9 Some,. hardship-considerations were that all competitors have <br /> 10 canopies'and -that --th-e pumps are at an angle which would make <br /> 11 it - quite expensive to move them. Mr . Sarna felt the hardship <br /> 12 would be one of economics . Commissioner Franzese suggested <br /> 13 that the canopy is a unique structure and could be considered <br /> 14 a hardship by its uniqueness . <br /> 15 <br /> 16 Councilmember Marks advised that economic hardship is never a <br /> 17 valid nor legal reason for approval of a variance. <br /> 18 <br /> 19 The Mayor stated it is not the intent of the Council to oppose <br /> 20 the canopy as it is recognized as a convenience for Mr . <br /> 21 Sarna ' s patrons . <br /> 22 <br /> 23 Mr . Sarna said he has viewed all options to move the pumps . <br /> 24 The City Manager felt the whole issue is one of design . He <br /> 25 observed that ingress and egress options , parking <br /> requirements , vehicular movement and the general layout of the <br /> property should be considered before any decision is made on <br /> 28 th2s request . <br /> 29 <br /> 30 Motion, by Marks, second by Wagner to lay this matter over <br /> 31 until it is reviewed by staff with Mr. Sarna and brought back <br /> 32 to the Council . <br /> 33 <br /> 34 Mr . Sarna noted that the hardship claimed by the Amoco Station <br /> 35 is not apparent . The Management Assistant explained the <br /> 36 hardship at the Amoco Station. <br /> 37 <br /> 38 The City Manager advised that if an error is made in granting <br /> 39 a variance another variance using this error as an example <br /> 40 cannot be done . <br /> 41 <br /> 42 Motion carried unanimously <br /> 43 <br /> 44 4 . Rezoning Properties Located on Silver Lake Road South of <br /> 45 39th Avenue <br /> 46 <br /> 47 This rezoning is being requested to correct a zoning error and <br /> 48 bring it into conformance with the St . Anthony Comprehensive <br /> 49 Plan . The properties will be rezoned from R-2/R-4 to <br /> 50 Commercial . <br /> • <br />
