Henry ' s neighbors stated that a garage setback so <br /> 7 far into the yard would be ugly and ruin the neighborhood . <br /> 8 <br /> 9 _. The City Manager advised that by ordinance thirty percent or <br /> 10 less- of-- a - parcel can be covered . Mr . Henry ' s request- would <br /> 11 comply with this ordinance requirement . He also noted this <br /> 12 could set a precedent as all corner lot owners could apply for <br /> 13 this permit if Mr . Henry ' s is approved . He questioned if the <br /> 14 Council wants to have garages built in backyards or detached . <br /> 15 He inquired if the Council desires staff to re-look the <br /> 16 ordinance and revisit the permit process . The question of <br /> 17 outbuildings is the issue as well . <br /> 18 <br /> 19 Councilmember Fleming felt the issue setting a precedent is <br /> 20 one of primary concern . It was also noted that some options <br /> 21 for Mr . Henry had been discussed at this meeting which were <br /> 22 not discussed at the Planning Commission meeting. <br /> 23 <br /> 24 Motion by Marks , second by Ranallo to lay this matter over , <br /> 25 return it to the Planning Commission and take up again when <br /> 26 the Planning Commission and staff have a recommendation . • <br /> 27 <br /> 28 <br /> 29 Motion carried unanimously <br /> 30 <br /> 31 <br /> 32 3 . Sarna, 3259 Stinson Boulevard - Setback Variance <br /> 33 <br /> 34 Mr . Sarna is requesting a variance for the placement of a <br /> 35 canopy over the gas pumps at his service station and grocery <br /> 36 store at 3259 Stinson Boulevard. The proposed canopy has been <br /> 37 reduced in width from thirty-two feet to twenty-eight feet . <br /> 38 Even with this reduction , a ten foot setback variance from <br /> 39 33rd Avenue and an eighteen foot setback variance from Stinson <br /> 40 Boulevard would be required as the City requires thirty-five <br /> 41 foot setbacks from the streets on both sides because the City <br /> 42 treats these as front yards . <br /> 4 3- <br /> 44 Mr . Sarna reduced the size of the canopy and the concrete slab <br /> 45 but is proposing no changes in the angle of the canopy. He <br /> 46 stated there is no signage being considered for the canopy. <br /> 47 <br /> 48 The Planning Commission recommended the Council approve a <br /> 49 twelve foot variance on the 33rd Avenue side and a twelve foot <br /> 50 variance on the Stinson Boulevard side . <br />
