• (b) are inundated or saturated by surface or ground water at a frequency and duration <br /> sufficient to support a prevalence of hydrophytic vegetation typically adapted for <br /> life in saturated soil conditions; and <br /> (c) under normal circumstances support a prevalence of such vegetation. <br /> 1675.05 Scope and Effect. <br /> Subd. 1 Applicability. Every applicant for a building permit, subdivision approval, or a <br /> permit in the Commercial, Industrial, R-3 and R-4 Zoning Districts of the City must <br /> submit a Storm Water Management Plan to the Public Works Director. No building <br /> permit, subdivision approval, or permit to allow land disturbing activities shall be issued <br /> until approval of the plan or a waiver of the approval requirement has been obtained <br /> under this Section. <br /> Subd. 2 Exemptions. The provisions of this Section do not apply to fences, sign or poles <br /> or emergency work, or to the following items if approved before the effective date of this <br /> Section: <br /> (a) Any part of a subdivision approved by the City Council before the effective date <br /> of this Section. <br /> (b) Any land disturbing activity for which plans have been approved by the watershed <br /> management organization. <br /> (c) A lot for which a building permit has been approved. <br /> (d) Building permits issued in the R-1, R-lA, or R-2 Zoning District. In these <br /> Districts,the property owner must obtain prior approval from-only the Director of <br /> Public Works of a storm water plan appropriate in scale and scope to the proposed <br /> activity when it is over one acre in size. <br /> 1675.06 Plan Approval Procedures. <br /> Subd. 1 Application. Any plan and an application for its approval shall be filed with the <br /> Public Works Director. It must state the grounds for approval, that the proposed use is <br /> permitted by the zoning ordinances, and adequate evidence that the proposed use will <br /> conform to this Section. Prior to applying, an applicant may have the plan reviewed by <br /> the appropriate departments of the City. <br /> The applicant must submit two sets of clearly legible blue or black lined drawings in <br /> appropriate scale (not less than 1 inch equals 100 feet) and the required additional <br /> information with evidence of payment of all fees required under Section 1675.07. <br /> • -3- <br />
