He questioned as to whether it would be brought back to Council if the <br /> 2 requirements could not be met. <br /> 3 <br /> 4 There was disagreement as to what Council had approved in their previous motion. Mr. <br /> 5 Morrison clarified that Council "did" approve the purchase of a sign, therefore, authorizing Staff <br /> 6 to move forward in the process. He continued in noting that the only stipulations that Council <br /> 7 put on the process is to ensure that it is not a safety issue and that it will remain within City code, <br /> 8 with regard to size, if possible. <br /> 9 <br /> 10 - Ayes -4, Nays—(Horst). Motion carried. <br /> 11 <br /> 12 C. Ordinance 04-004; Section 515 Dogs, Allowing three dogs per household and changing <br /> 13 immunization requirements. (3rd Reading) <br /> 14 City Manager Mornson reviewed the third version of the amended dog ordinance. He noted this <br /> 15 version, as in version two, contains the amended immunization for rabies text. <br /> 16 <br /> 17 Mr. Morrison indicated that Staff has added a section 515.05, titled Special Multiple Dog <br /> 18 License, adding this would allow the City ordinance to maintain the two dog restriction but <br /> 19 residents wishing to possess three dogs could obtain a license with the following conditions: <br /> 20 a.) Written approval of the occupants from at least seventy-five percent (75%) If the <br /> 21 residential property within 200 feet of the licensed premised. <br /> 22 b.) Fenced Yard: The yard of the licensed premises is fenced in such a manner as to <br /> 23 the restrain dogs on the premised from leaving the yard. <br /> 24 c.) Nuisance: Dogs kept on the licensed premised do not create a nuisance by excess <br /> 25 barking or by creating unsanitary conditions. <br /> 26 d.) Fee: Payment of a yearly license fee of$20.00. <br /> 27 e.) Denial of application: The Chief of Police may deny requests for renewal of a <br /> 28 special multiple dog license based upon complaints received during the <br /> 29 preceding year. In the even of such a denial, the applicant may within ten (10) <br /> 30 days of being advised of the denial, request, in writing, a hearing before the City <br /> 31 Council on the denial. <br /> 32 <br /> 33 Mr. Mornson stated these conditions place the responsibility of having the extra dog with the <br /> 34 resident. All provisions for A thru E are only for a third dog. <br /> 35 <br /> 36 Motion by Councilmember Faust, seconded by Councilmember Stille, to Approve Ordinance <br /> 37 04-004; Section 515 Dogs, Version 3, Allowing Three Dogs per Household and Changing <br /> 38 Immunization Requirements. (3d Reading) <br /> 39 <br /> 40 Discussion: <br /> 41 Councilmember Thuesen indicated that he still disagrees with the revised ordinance in that Staff <br /> 42 and Council are mixing enforcement with responsible dog ownership. He suggested that if an <br /> 43 individual is required to complete the permitting process, they should be required to do the same <br /> 44 for a second dog. He concluded in noting that he does not support the motion. <br /> 45 <br />
