City Council Regular Meeting Minutes 12 <br /> July 27, 2004 <br /> Page 12 <br /> 1 Councilmember Horst stated.that he is surprised with the amount of controversy this issue <br /> 2 caused. He indicated that there are two sides to every story,adding that he believes the <br /> 3 agreement that was decided upon is a"compromise". He noted that he believes it is the best"that <br /> 4 could be done, suggesting that no matter what the outcome may be someone will not be happy. <br /> 5 He concluded in noting that he is in support of the motion. <br /> 6 <br /> 7 Councilmember Stille indicated that he believes the standard should be two dogs per household. <br /> 8 He made reference to a call he received from a resident stating that the City should allow no <br /> 9 dogs. Despite the differences in views, he noted that Staff had to "compromise"and meet in the <br /> 10 "middle of the road". He added that if a resident demonstrates responsible dog ownership of two <br /> 11 dogs, that they have the option to gain the "acceptability"of their neighbors for a third dog. He <br /> 12 concluded in noting that he is in support of the motion. <br /> 13 <br /> 14 Councilmember Faust stated once again that Staff had to reach a"compromise", adding that the <br /> 15 original standard of two dogs per household had not changed,however, an option has been added <br /> 16 to receive a third. He suggested that should an individual obtain a third dog and not be <br /> 17 responsible in caring for them, then they could lose their right in ownership with renewing their <br /> 18 multiple pet permit. He concluded in noting that he is in support of the motion. <br /> 19 <br /> 20 Mayor Hodson stated that he will support the motion, adding, however, that he is not in <br /> 21 agreement with the revisions made. He continued in urging residents to try and resolve issues <br /> 22 regarding irresponsible dog owners within their neighborhood, noting that if the issue still <br /> 23 presents itself to contact the police. <br /> 24 <br /> 25 Councilmember Faust added that residents should contact the police regarding unlicensed dogs <br /> 26 also. <br /> 27 <br /> 28 Ayes-4,Nays-1 (Thuesen). Motion carried. <br /> 29 <br /> 30 D. Ordinance 04-005; Review and Amend Ordinance 1210-03, of Certain Animal <br /> 31 City Manager Morrison reviewed the amended City Ordinance 1210.02 to reflect the changes in <br /> 32 City Ordinance 515, asking Council to consider waiving the first and second readings of this <br /> 33 City Ordinance change to correspond with the third reading of the Dog Ordinance. He reported <br /> 34 the changes as follows: <br /> 35 <br /> 36 1210.02 - Keeping of Certain Animals. No person may keep swine, cattle,horses, goats, <br /> 37 or more than two dogs or three dogs allowed under City Ordinance 515 or fowl, <br /> 38 within the City nearer than 500 feet to any human habitation or platted land, without <br /> 39 approval of the Council. The Council may, before approving or denying any request for <br /> 40 approval, request a report from the Health Officer concerning the effect on public health. <br /> 41 <br /> 42 Motion by Councilmember Horst, seconded by Councilmember Faust, to Approve Ordinance <br /> 43 04-005; Review and Amend Ordinance 1210-03, waiving the 2nd and 3rd Readings;Keeping of <br /> 44 Certain Animals. <br /> 45 <br /> 46 Motion carried unanimously. <br />
