Mr. Krier suggested the format of the interviews he distributed should be followed as closely as possible so the inter- views would be perceived to be fair by the developers. The consultant said his experience with developers has been that they want interviews held as close together as possible and conducted in as formal manner as possible for fairness . For this -reason, Mr. Krier indicated he believes it to be essential that only the H.R.A. members be permitted to participate in the questioning , with the Attorney permitted to clarify any legal questions . He also recommended the proceedings be taped and recorded to avoid any misunderstandings later. When asked at what point public input to the planning would be sought, the consultant indicated that on February 22nd the H .R.A. would appoint a tentative developer and accept a general plan for the project, by resolution, after which there would be 90 days in which the plans could be fine-tuned before an agreement with the developer is signed and it would be in this interim that the H.R.A. could seek the advice and input of the public and other participants in the planning process . Mr. Soth entered the meeting during this discussion and, when Mr. Krier suggested the meeting scheduled for 5 :00 P .M. , February 11th, where the H. R.A. would discuss the proposals , should be closed to the public, gave his thoughts on that proposal . He said up until a recent meeting of city attorneys , he had believed such meetings -should be open, but information he received at that time raised the question in his own mind whether the violation of rights of privacy would not be involved as well as the open meeting laws if the public were permitted to attend the meeting where confidential economic information provided by the firms would be discussed. He said he would research the matter further. The attorney added that other persons have no legal right to speak during interviews which are by nature , public hearings , not debates . Mr . Soth also advised that it be made clear that the selection of a developer is only tentative in order that claims against the City later would be negated in the event the negotiations which follow selection fail to produce a viable project.
