Planning Commission Report .- .October 3, 1989 Meeting <br /> 3 <br /> 4 John Madden, Chairperson of the' Planning Commission, presented the following <br /> 5 agenda items from the October 3rd Planning Commission Meeting: <br /> 6 <br /> 8 1 . Holten, 2909 Rankin Road - Setback variance request <br /> 9 Motion by Marks, second by Makowske to grant an eight foot front yard setback <br /> 10 variance at 2909 Rankin Road , finding that the three questions asked in the <br /> 11 variance petition were answered affirmatively and satisfactorily and that no <br /> 12 one spoke against the request; that the variance apply only to this particular <br /> 13 lot based on its unique configuration; and that the house be placed upon the <br /> 14 lot as indicated in drawings submitted to the Planning Commission. <br /> 15 <br /> 16 Bruce Holten , property owner at 2909 Rankin Road , advised the Council that <br /> 17 when the house is built it will . line up with the house to the north. <br /> 18 <br /> 19 20 Councilmember Marks observed that this is a classic case of a hardship <br /> 21 situation. <br /> 22 Motion carried unanimously <br /> • 23 <br /> 24 2. Yarr, 3104 Armour Terrace, Fence variance request <br /> 25 <br /> 26 Chairman Madden advised the Council that this fence had been erected before <br /> �7 a permit was requested. During the fence construction Larry Hamer, Public <br /> 28 Works Director, had visited the- site on a number of occasions to advise the <br /> �9 property owners that the fence violated the height provision of the fence <br /> 30 ordinance. He also advised them of this by letter. It was noted that many <br /> 31 neighbors of the Yar-rs had indicated their opposition to the height of the <br /> 33 fence. <br /> 34 Motion by Marks, second by Ranallo to deny the variance request for seven .foot <br /> 35 fencing at 3104 Armour Terrace on the basis that no hardship nor extraordinary <br /> 3.6 . circumstances have been shown to exist which would justify a variance; and that <br /> 37 no one appeared to speak in favor of the variance request while many opposed <br /> 39 it. <br /> 40 Motion carried unanimously <br /> 41 <br /> 42 <br /> 43 3. Clark' s Submarine Sandwich, 2922 Pentagon Drive - Conditional use request/ <br /> 45 Sign variance. request <br /> 46 Chairman Madden. stated the conditional use permit. is for a restaurant which is <br /> 47 a permitted use in that location. Councilmember Ranallo observed that the requested <br /> 48 hours- of operation were from 10:00 a.m. to 2:00 a.m. . The City Attorney read that <br /> 49 section of the ordinance governing hours of operation noting the ordinance requires <br /> 50 <br />
