THROUGH LOT: Section 2 Subdivision 2 number 52 defines "through lot" as follows: <br /> 52. Lot, Through - A lot which has a pair of opposite lot lines abutting two <br /> substantially parallel streets, which is not a corner lot. On a through lot, both street <br /> lines shall be front lot lines for applying this Ordinance. <br /> The east lot line of the property abuts on the Hennepin County right-of-way. If the right-of- <br /> way is to be treated as a "street", then the property should be deemed to be a "through lot", <br /> even though it is also a "corner lot". We believe that the drafters of the definition never <br /> contemplated that a condition could exist where a through lot was also a corner lot. But <br /> that appears to be the case here if the right-of-way is considered to be a street, which would <br /> seem logical since it could be opened as a stgreet at any time the County might choose to <br /> do so. If the property is a "through Lot", then the setbacks for this site would be 35 feet on <br /> the east, west and south side of any structure constructed. <br /> COMPREHENSIVE PLAN: The City's comprehensive plan needs to be reviewed to <br /> determine how this area should be zoned. The present Land Use Plan is not clear on what <br /> the appropriate use for this area should be. The City began to discuss land use questions at <br /> the time of the Kenzie Terrace Revitalization Program, however, this area was not included. <br /> It may be appropriate that this area be studied to determine the most appropriate land use, <br /> traffic circulation and image as a gateway into St. Anthony. <br /> STAFF RECOMMENDATION <br /> No formal action is needed by the Planning Commission other than comments on the proposed <br /> development. Because the development does not meet the requirements of the ordinance, the <br /> developer must make the decision if they would like to proceed with development of this site. <br /> Regardless of this proposal, there are many planning issues in this area. The Planning Commission <br /> may want to recommend a moratorium on development of this area until all the planning questions <br /> relating to use, traffic and the comprehensive plan can be addressed. <br />
