City Council Regular Meeting Minutes <br /> February 13, 1996 <br /> Page 4 <br /> I Mr. Stan Guzak, Jr.,President of the Silver Lake Homeowner's Association expressed <br /> 2 concern that if the subdivision is granted,each lot will have their own title. Opus <br /> 3 Corporation will develop the largest piece and address the drainage but the other two lots. <br /> 4 will be separate issues. <br /> 5 Mayor Ranallo indicated that was not the case. If Opus Corporation redevelops the other <br /> 6 part of the property,they will be required to install drainage ponds. This is not marked <br /> 7 on the drawing because it is not clear where it will fit in with the design. It will be <br /> 8 - included on the final plat. <br /> 9 Mr. David Greening, lawyer for Ste.Marie Corporation,explained Tires Plus is already a <br /> 10 separate legal distinct lot. Even as it sits today, it could be sold. Taco Bell is part of a <br /> 11 larger lot which will be reconfigured. He stated redevelopment of the main portion of the <br /> 12 shopping center is expected to occur and the Rice Creek Watershed District will be <br /> 13 looking at the whole area. <br /> 14 Mr. Soth concurred that a requirement of further development will be to install additional <br /> 15 pondage. The pond maintenance agreement will require the two lots to be responsible for' <br /> 16 a proportional share of the ponds now and future ponding. So if a lot is sold,the new <br /> 17' owner will still be obligated. This will run with the title of the property. The reciprocal <br /> 18 easement agreement also ties the lots together for common maintenance. <br /> 19 Motion by Marks, second by Enrooth to approve the subdivision for the property known <br /> 20 as Apache Plaza as long as all twelve issues identified in a January 24, 1996 letter to the <br /> 21 Planning Commission by legal counsel William Soth are resolved by the City of St. <br /> 22 Anthony administration. <br /> 23 Motion carried unanimously. <br /> 24 <br /> 25 2. Variances for Zero Lot Line Placement and Side Yard Setback, <br /> 26 Motion by Marks, second by Faust to approve a 10 foot sideyard/zero lot line request for <br /> 27 the property known as Apache Plaza,Lot 7. <br /> 28 Motion carried unanimously, <br /> 29 3. Comprehensive Sign Packaee. <br /> 30 Morrison noted it was not reflected in the Planning Commission meeting minutes that <br /> 31 Commissioner Gondorchin motioned to approve the comprehensive sign package with <br /> 32 the exception that all proposed ground signs comply with City code. City code states the <br /> 33 maximum size allowed for ground signs is 8 feet by 8 feet. Opus Corporation is <br /> 34 requesting ground signs of 8 feet by 12 feet. <br />
