The proposed use is one which is specifically listed for the zoning district where the <br /> 4 use will be located; <br /> 5 2. The proposed use will not be detrimental to the health, safety, or general welfare of <br /> 6 the persons residing or working in the vicinity; <br /> 7 3. The proposed use is desirable at the above location to provide a service and is in the <br /> 8 interest of public convenience and will contribute to the general welfare of the <br /> 9 neighborhood community; <br /> 10 Subject to the following conditions: <br /> 11 1. The proposed layout will be done in accordance with the drawings submitted to the <br /> 12 City as part of the approval; <br /> 13 2. The proposed layout be subject to approval of the Fire Chief for movement and access <br /> 14 of emergency vehicles; <br /> 15 3. Petroleum storage and drainage requirements conformity with local and state <br /> 16_ requirements. <br /> 17 4. No one present.spoke against the request. <br /> 18 Motion by Wagner, second by Faust to approve the conditional use permit for John Trautz, <br />_ 19 Freedom Gas Station, Lot 4, Apache Plaza based on the findings of the Planning Commission. <br /> 20 Motion carried unanimously. <br /> 21 Mayor Ranallo verified that the variance request was not required as the proposal was located <br /> 22 in the Apache Plaza and City Ordinance addressed this situation. <br /> 23 Morrison confirmed this was correct. He then asked when construction would begin. <br /> 24 John Trautz, applicant, stated construction would begin in mid August. <br /> 25 2. Ordinance 1997-005, re: Professional Buildings as Permitted Conditional Use in <br /> 26 Commercial Districts ( 1st Reading ). <br /> 27 City Manager Morrison reported the Planning Commission has recommended a proposed <br /> 28 ordinance amendment to the City's Zoning and Land Use Ordinance. It is recommended that <br /> 29 Chapter 16, Zoning and Land Use, Section 1635.03, Permitted Conditional Uses, be amended <br /> 30 to allow additional permitted uses in the Commercial District. These uses include laboratories <br /> 31 for medical research and testing (except research and testing which uses animals) that provides <br /> 32 services to health care providers, and computer research and program development. The City <br /> 33 Attorney has reviewed this proposed amendment and has agreed that the uses be included in <br /> 34' the Code as additional permitted uses. <br />
