A petition was presented and the police chief has no problem with this request. Wagner <br /> 7 asked if that would make the intersection a four-way stop. Mr. Mornson stated it would. <br /> 8 Motion by Faust, second by Wagner for approval of placement of a stop sign at 30'-Avenue <br /> 9 NE and Edward Street. <br /> 10 Motion carried unanimously <br /> 11 C. Mr. Ron Hansen appeared as a follow up to his appearance at the last Council Meeting. He <br /> 12 stated the Ordinance gives the requirement of written notice and a 30 day waiting period <br /> 13 before any signs are permitted. He believes the 30 day waiting period is ridiculous. He <br /> 14 requested Council look at the Ordinance and amend it to allow signs to be removed. <br /> 15 Mayor Ranallo suggested this go back to the Planning Commission for review. Mr. Hansen <br /> 16 stated he received a copy of a memorandum and believes it states Council will allow the sign <br /> 17 to remain. Mayor Ranallo stated after reading the memorandum, the Council, Staff, and City <br /> 18 Attorney find that the sign was constructed under the Ordinance and will allow to remain. <br /> 19 Mr. Hansen stated the Ordinance states those types of signs are not allowed in an R-1 district. <br /> 20 He noted a number of inconsistencies. <br /> 21 Councilmember Marks arrived at 8:10 p.m. <br /> 22 Mr. Hansen requested the sign be removed or the applicant be required to submit an <br /> 23 application for variance. He stated this is not a commercial property. He questioned why the <br /> 24 commercial section of the code is being looked at when considering this sign. The City made <br /> 25 an error and the City needs to get the matter resolved. This is an exact duplicate of what <br /> 26 happened a couple of blocks away on the Pirino property. . Mayor Ranallo stated he will <br /> 27 forward Mr. Hansen's request to the City Attorney for review. <br /> 28 Wagner requested Mr. Hansen write his concerns and provide them to Council. Mr. Hansen <br /> 29 stated the burden of proof should not lie on the citizens but rather should be on the City who <br /> 30 made the error. He suggested Council read the Ordinance as it applies to this residential <br /> 31 property. The neighbors are not in favor of the sign. Mr. Hansen stated he would like to <br /> 32 have the City Attorney's opinion in writing. <br />
