Some of the <br /> 2 businesses inquiring are not very good in his opinion. He stated.he could sell the site if that <br /> 3 - is.what he is economically forced to- do.- 'CUB is a big-generator of business and that is why <br /> 4 he originally acq uired the site. <br /> 5 Motion by Marks, second by Enrooth to approve the 25 foot variance request to the-front yard <br /> 6 setback requirement for Exhaust Pros, 4000 Silver Lake Road. <br /> 7 Marks stated he would not vote in favor of this request as he saw no valid hardship <br /> 8 whatsoever. <br /> 9 Mayor Ranallo stated he had spoken with Mr. Morgan, 3933 Silver Lake Road and <br /> 10 acknowledged receipt of his letter of complaint to the proposal. Mr. Morgan was not able to <br /> 11 attend the meeting this evening but-stated he is still in opposition to the request. <br /> 12 Vote on the motion: Ranallo, Enrooth, Faust, Marks and Wagner voted naye. <br /> 13 Motion failed. <br /> 14 Marks suggested the City Attorney draft the conditions for approval of the conditional use <br /> 15 permit to ensure.the City obtain the desired results. <br /> 16 Mayor Ranallo questioned if the conditional use permit request was still valid due to the <br /> 17 denial of the variance request. The entire layout of the proposal may need to be changed. <br /> 18 Soth questioned if the applicant would want to proceed without the car wash. <br /> 19- Faust suggested consideration of the conditional use permit be tabled to allow the applicant to <br /> 20 make these decisions. <br /> 21 Motion by Enrooth, second by Marks to table consideration of the conditional use permit for <br /> .22 Exhaust Pros, 4000 Silver Lake Road,-pending if the applicant still desired. the conditional use <br /> 23 . . permit. <br /> Motion carried unanimouLIL- <br /> 24 <br /> 25 Mornson noted Mr. Rosar has offered to present the City with a cash escrow to guarantee the <br /> I ' ' <br /> 26 improvements. The Planning Commission was not comfortable as they have not'required this <br /> 27 in the past. <br /> 28 Soth stated this could be a condition of the conditional use permit. He also reiterated if the <br /> 29 conditions of the conditional use permit are not met, the business is in violation of the permit. <br /> . 30 <br /> 2.
