City Council Regular Meeting Minutes <br /> June 23, 1998 <br /> Page 4 <br /> 1 Commissioner Makowske reported a public hearing was held to consider a request by <br /> 2 Krause/Anderson for a Conditional Use Permit to locate Robodyne Corp., in the vacant building <br /> 3 at 2550 Highway 88, formerly known as the Town& Country grocery store. The City-Attorney <br /> 4 advised the Planning Commission that the request could be approved as an allowable use or a <br /> 5 conditional permitted use, or denied on the basis that it is an incompatible use. Makowske noted <br /> 6 that the City is currently in the process of considering the redevelopment of the entire south end <br /> 7 of the City. <br /> 8 Robodyne is currently located in the industrial park of St. Anthony. Originally the Planning <br /> 9 Commission suggested that the owner, Mr. Alvite, look for property in the industrial park. <br /> 10 However, there are no properties which meet his size requirements at this time or for the future. <br /> 11 Robodyne requires 25,000 square feet and the Town and Country building is 37,00.0 square feet <br /> 12 which will provide for their current and future needs. <br /> 13 A letter received by the City from Rodney Johnson, Real Estate Manager for St. Anthony <br /> 14 Minneapolis Inc., dated May 28, 1998, stating that he was adamantly opposed to the granting of <br /> 15 the conditional use permit for the relocation of Robodyne to 2550 Highway 88, was read into the <br /> 16 record at the Commission meeting. <br /> 17 <br /> 18 Due to the ongoing redevelopment process and the fact that Krause/Anderson had attempted to <br /> 19 market this building for a retail use for one year with no success,the Planning Commission <br /> 20 determined the best solution was to allow the use with a Conditional Use Permit with the <br /> 21 stipulation that if will expire at the end of five years. This will allow a current St. Anthony <br /> 22 business owner and employer who has made significant investment in the residents of St. <br /> 23 Anthony, to remain in the City, and will provide Krause/Anderson with funds to pay taxes and <br /> 24 will fill a vacant building in the City. However, Mr. Alvite's contract with Krause/Anderson <br /> 25 includes the option to purchase the property at the end of five years and if the Conditional Use <br /> 26 Permit is not renewed, Mr. Alvite could not utilize the property for the same use. <br /> 27 Commissioner Makowske reported that the Planning Commission voted 4-0-1 abstention in <br /> 28 favor of granting a Conditional Use Permit to locate Robodyne Corp. in the building at 2550. <br /> 29 Highway 88 based on the following: <br /> 30 1. The proposed conditional use is a conditional use specifically allowed for this zoning <br /> 31 district. <br /> 32 2. The proposed use will not be detrimental to the health, safety, or general welfare of <br /> 33 persons residing or working in the vicinity or injurious to property values or <br /> 34 improvements to the vicinity. <br /> 35 3. The proposed use is necessary or desirable at the above location to provide a service or a <br /> 36 facility which is in the interest of public convenience and will contribute to the general <br /> 37 welfare of the neighborhood or community. <br /> 38 4. The Conditional Use Permit will expire five years from February 1, 1999 or five years <br /> 39 from the date that Mr. Alvite opens for business,whichever comes first. __ <br />
