Minnesota Statutes and City Ordinances require that the following conditions be satisfied before a <br /> conditional use may be authorized. Please respond to these conditions, using additional sheets, if <br /> necessary. <br /> 1) The proposed conditional use is one of the conditional uses specifically listed for the zoning district in which it <br /> is to be located. There is no specific mention of this type of use listed in your Section 1600"zoning code" except as <br /> referenced in Section 1650.04 "Height Limit Exceptions" There we find mention of antennas and towers. The <br /> subject of Antennas and Towers are more specifically discussed in Section 1160.As noted in Section 1160.02, a <br /> permit application must be made with the City and approval granted prior to construction of this antenna facility. <br /> Section 1160.04 states"General Requirements". <br /> Subd. 1. Nextel will comply with the State Building Code. <br /> Subd. 2. Grounding protection will be applied to protect people and property against a direct lightning strike. <br /> Subd. 3.Antennas will be in compliance with the required distance from overhead power lines as no overhead <br /> power line crosses'the building rooftop. <br /> Subd. 4. This rooftop is secure from unauthorized person's access. <br /> Subd. 5. This site will have no permanent lighting of any kind except that which may be required to repair site <br /> in an emergency. <br /> Subd.6. Construction materials used in the equipment building as well as the antenna support structures are <br /> of a non-corrosive, non-combustible material and uses no wood. <br /> Subd. 7. This installation will not extend or encroach on any part of a street,sidewalk or alley. <br /> 2) The proposed conditional use will not be detrimental to the health,safety,or general welfare of persons residing <br /> or working in the vicinity or furious to property values or improvements in the vicinity. A rooftop installation <br /> ® such as the one we are proposing at this site will without question have the lease impact of any alternative structure <br /> such as ground build tower, or water tank There will be no equipment placed on the ground.Everything will be <br /> placed on the building roof and become a part of the building. <br />
