COMMUNICATION WITH CITY COUNCIL <br /> 2 6.1 Designate a Planning Commission member to the March 23 2004 City Council Meeting <br /> 3 <br /> 4 Chair Stromgren stated that he would attend the City Council meeting on March 23, 2004. <br /> 5 <br /> 6 VII. PUBLIC HEARING. <br /> 7 <br /> 8 7.1 Frank Peterson setback variance request for property located at 2601 —31"Avenue <br /> 9 Northeast. <br /> 10 <br /> 11 Chair Stromgren opened the Public Hearing at 7:03 p.m. <br /> 12 <br /> 13 City Manager Morrison stated the Planning Commission had a Concept Review for this request. <br /> 14 He explained that the request is for an 11-foot setback variance to allow construction of a three- <br /> 15 season porch. He further explained that the ordinance requires a 30-foot setback and the property <br /> 16 owner would have a 19-foot setback, if approved. He stated that the applicant currently meets <br /> 17 the requirements for lot coverage and other setback requirements. He stated that the Building <br /> 18 Inspector has determined that a side yard set back is required versus a front yard because it is a <br /> 19 corner lot. He noted that they have latitude to interpret the various setbacks on a corner lot in <br /> 20 order to decide what would make the most sense for each situation. He reviewed the Public <br /> 21 Hearing notification process with the Commission stating that the Public Hearing was published <br /> 22 in the local newspaper and a notice was mailed to property owners located within 350-feet from <br /> 23 the applicants address. He indicated that the City did receive four phone calls regarding the <br /> 24 property and explained that there were no problems,just curiosity with respect to what was <br /> 25 happening with the property. He noted that the property owner is available for any questions. <br /> 26 <br /> 27 Frank Peterson explained that he and his wife are requesting an 11-foot setback variance to allow <br /> 28 them to construct a three-season porch. He reviewed the location with the Commission noting <br /> 29 that the porch would face 30th Street Northeast. He indicated that he had researched the area to <br /> 30 locate other homes that have built 30-feet from the curb line noting that there are several in his <br /> 31 area. He reviewed his findings with the Commission adding that the porch would also allow his <br /> 32 wife to spend some time outside the house in the summer. He noted that she has a medical <br /> 33 condition that would not allow her to go outdoors otherwise. <br /> 34 <br /> 35 Commissioner Tillman noted the fence around Mr. Peterson's yard and asked how long it had <br /> 36 been up. She asked if the fence would require a variance. City Manager Morrison clarified that <br /> 37 his fence was probably installed prior to the ordinance and is grandfathered. <br /> 38 <br /> 39 Commissioner Tillman noted the tree in the front yard and asked if it would remain. Mr. <br /> 40 Peterson confirmed that the tree would stay. He explained that the porch would only extend one <br /> 41 foot past the sidewalk. <br /> 42 <br /> 43 Chair Stromgren closed the Public Hearing at 7:08 p.m. <br /> 44 <br />
