Planning Commission Meeting Minutes <br /> March 16, 2004 <br /> Page 3 <br /> 1 Commissioner Tillman noted that in giving this request consideration she drove through the area <br /> 2 to get a feel for the characteristics of the locality and homes in the neighborhood. She referenced <br /> 3 the conditions of approval: altering the characteristics of the locality; does not affect reasonable <br /> 4 use; a hardship was not created by the owner. She stated that in her review of the neighborhood <br /> 5 and surrounding homes she noted that the porch would not alter the characteristics of the locality <br /> 6 nor would it deter reasonable use or access to the main structure/home. She also acknowledged <br /> 7 Mrs. Peterson's asthma stating that the addition would allow Mrs. Peterson an opportunity to <br /> 8 enjoy the outdoors in a protected environment. She noted that they are stretching the <br /> 9 requirements a bit adding that the proposed addition would not alter or deter from the appearance <br /> 10 of the surrounding neighborhood. <br /> 11 <br /> 12 Commissioner Hoska agreed stating that he too drove through the area a couple of times. He <br /> 13 noted that several homes were set back and forth along the streets. He stated that in considering <br /> 14 the entire situation, in general, he has not found a reason why they shouldn't recommend the <br /> 15 request to City Council. He stated that the Petersons have a very nice, well-kept home and that <br /> 16 the porch would make a nice addition. <br /> 17 <br /> 18 Vice Chair Hanson noted another consideration for approval was whether the request would add <br /> 19 value to the property. He stated that this addition would raise the value of the property and <br /> 20 agreed that it would make a nice addition. He expressed his agreement with Commissioner <br /> 21 Tillman stating that they are stretching the requirements a bit adding that they have done it <br /> 22 before. <br /> 23 <br /> 24 Motion by Commissioner Tillman, seconded by Vice Chair Hanson, to recommend that City <br /> 25 Council grant the applicant's request for an 11-foot side-yard variance under the criteria that first, <br /> 26 a hardship was not created by owner; the home is on odd shaped lot and like that when <br /> 27 purchased; the structure would not alter the locality; economic considerations not applicable; and <br /> 28 due to extenuating circumstance for Mrs. Peterson's health. <br /> 29 <br /> 30 Motion carried unanimously. <br /> 31 <br /> 32 Chair Stromgren stated that City Council would consider this request at their March 23, 2004 <br /> 33 Regular meeting. He suggested that the Peterson's be present to answer any questions the <br /> 34 Council might have. <br /> 35 <br /> 36 7.2 Tires Plus, conditional use permit and administrative subdivision for property located <br /> 37 adjacent to the TCF on Silver Lake Road. <br /> 38 <br /> 39 Chair Stromgren opened the Public Hearing at 7:10 p.m. <br /> 40 <br /> 41 City Manager Morrison stated that the applicant, Tires Plus, is purchasing two lots and 27 feet off <br /> 42 of a third lot from TCF, their neighbor to the north. He stated that because part of one lot would <br /> 43 stay with Tires Plus and one part of the lot would remain with TCF a public hearing is required to <br /> 44 approve the dividing of an existing lot. He reviewed the request with the Commission stating <br /> 45 that the applicant is currently located next to the City Liquor store on the west side of Silver Lake <br />
