City Council Regular Meeting Minutes <br /> January 6, 2004 <br /> Page 19 <br /> 1 improve without considering a small variance. <br /> 2 <br /> 3 Motion carried unanimously. <br /> 4 <br /> 5 Motion by Councilmember Horst, seconded by Councilmember Faust, to adopt Resolution 04- <br /> 6 012,Denying Front Yard Setback Variance for 2800- 34`'Avenue NE. <br /> 7 <br /> 8 Discussion: <br /> 9 <br /> 10 Councilmember Horst stated he supports denial of the front yard setback variance request <br /> 11 because of the importance of maintaining the view of a neighborhood and not radically change <br /> 12 it. He noted that the previous consideration still allows the property owner some options. <br /> 13 <br /> 14 Councilmember Stille explained that the City is required by State Statutes to find a hardship and <br /> 15 economics is not a consideration for a hardship. <br /> 16 <br /> 17 Councilmember Faust stated that he served six years on the Planning Commission and has seen <br /> 18 issues for a front yard setback. Over the years, the Council and Planning Commission have tried <br /> 19 to maintain front yard setbacks and are required by Minnesota Statutes to maintain those values. <br /> 20 He encouraged Mr. Rabine to pursue a different avenue to make the improvement and stated that <br /> 21 he thinks value will be gained back since the character of the neighborhood would be unchanged. <br /> 22 <br /> 23 Motion carried unanimously. <br /> 24 <br /> 25 Councilmember Thuesen stated he wanted to publicly thank Chris Melsha for his service on the <br /> 26 Planning Commission. <br /> 27 <br /> 28 VII. GENERAL POLICY BUSINESS OF THE COUNCIL. <br /> 29 A. Todd Hubmer,WSB &Associates,Inc.,Presentation of Resolutions Relating_to 2004 <br /> 30 Street Improvements Assessments. <br /> 31 Mayor Hodson recognized Todd Hubmer and welcomed him to the meeting. <br /> 32 <br /> 33 Mr. Hubmer, WSB &Associates,Inc. approached the Council and presented three resolutions <br /> 34 for the Council's consideration. He stated the bid will be received and reviewed by the Council <br /> 35 at their February 24, 2004 meeting. He noted it is a very favorable bidding environment and <br /> 36 noted the low bid received is from S.M. Hentges & Sons, Inc. in the amount of$1,288,929.58, <br /> 37 which is below the engineer's estimate. <br /> 38 <br /> 39 1. Resolution 04-013, re: Call Hearing on 2004 Street and Utility!Wrovements. <br /> 40 Mr. Hubmer reviewed the resolution and indicated the streets involved are Belden Drive between <br /> 41 32nd Avenue and 33`d Avenue; Hilldale Avenue between Belden Drive and Silver Lake Road; <br /> 42 32nd Avenue between Belden Drive and Silver Lake Road; and, Townview Avenue between <br /> 43 Wilson Street and Silver Lake Road. He stated the public hearing will be held on February 10, <br /> 44 2004. <br /> 45 <br /> 46 Motion by Councilmember Faust, seconded by Councilmember Horst, to adopt Resolution 04- <br />
