CITY OF ST. ANTHONY <br /> COUNCIL MINUTES <br /> July 14 , 1981 <br /> The meeting was called to order by .Mayor. Haik at .7 :30 P.M. <br /> Present for roll call : Letourneau, Ranallo, Haik and Sundland. <br /> . Absent: Marks. <br /> Also present:. Larry . Hamer, Acting City Manager; Ron Berg.; Administra- <br /> tive Assistant; William Soth, City Attorney; and Carol <br /> Johnson, - Clerk/Treasurer. <br /> Motion by Councilman Sundland and seconded. by Councilman Letourneau <br /> to approve. as submitted the minutes to ,the Council meeting held <br /> June 23 , 1981. <br /> Motion carried unanimously. <br /> The minutes of the June 25th meeting of the Advisory Committee to the <br /> Health Board were accepted as informational and the ordinance they <br /> had developed to establish a housing -maintenance code for multiple <br /> dwellings was considered. Mr. Soth reported that, although he had, <br /> at Mr. Fornell' s request, researched several legal questions which <br /> might arise in relation to the development of such an ordinance, and <br /> had recommended Brooklyn Park' s ordinance as a. model for the City, <br /> he had not yet specifically reviewed the ordinance which. the Com- <br /> mittee had developed in the context of .the City's needs . He would <br /> therefore prefer redrafting the ordinance before the first reading is <br /> approved. by the Council, incorporating any suggestions they might wish <br /> to make. The City Attorney . indicated .he did not believe the ordinance <br /> could be used to shut down a non-conforming facility but rather <br /> saw the value of the ordinance as a mechanism of enforcement for the <br /> City where landlords fail to meet the maintenance: standards set in <br /> the ordinance. Mr. Soth agreed with Mayor Haik that the ordinance <br /> might also provide the tenants with grounds to file against such <br /> landlords . The Mayor then suggested the development of the ordinance <br /> should be publicized in the City Newsletter so tenants may effectively <br /> utilize the new regulations. <br /> -The .Council .agreed .Ordinance 1981-00.9. should be rewir.tten with stand- <br /> ards for..duplexes or double ,bungalows .eliminated because of legal <br /> difficulties with enforcement forsuchdwellings. . They also requested <br /> Mr. Soth to check if the definition of "family" in the proposed ordin- <br /> ance had not been sufficiently .addressed elsewhere in the City <br /> ordinances and favored an ordinance requirement for replacement of <br /> .vegetation which dies or has been destroyed, if such vegetation is <br /> deemed necessary to the health, safety or . welfare of the dwelling <br /> residents. <br /> ORDINANCE 1981-009 <br /> AN ORDINANCE RELATING TO MULTIPLE DWELLINGS , <br /> LICENSES AND REGULATIONS, AMENDING SECTION <br /> 310 :00 BY ADDING A SECTION 310 :10 OF THE <br /> 1973 CODE OF ORDINANCES <br /> No action was taken. <br />
